ORDINANCE 2013 -11 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AMENDING CHAPTER 2, ARTICLE 3 — BOARDS, COMMITTEES AND COMMISSIONS, DIVISION 18 -- ANIMAL SHELTER ADVISORY COMMITTEE BY AMENDING SECTION 2.366 OF THE SAN MARCOS CITY CODE TO ADD THE CITY OF BUDA AS A MEMBER OF THE ANIMAL SHELTER ADVISORY COMMITTEE; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING AN EFFECTIVE DATE. RECITALS: 1 The San Marcos City Council entered into an interlocal agreement (" Agreement") with the City of Buda, Texas on December 14; 2011, for the provision of animal shelter services to the City of Buda relating to the proper care of animals, response to animal related issues and funding for said services. 2. The Agreement authorizes a representative to the San Marcos Animal Shelter Advisory Committee appointed by the Buda City Council. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. Chapter 2, Article 3 — Boards, Committees and Commissions, Division 18 — Animal Shelter Advisory Committee, Section 2.66 of the San Marcos City Code is hereby amended to read as follows (underlining indicates added text and strikethroughs indicate deleted text): DIVISION 18. - ANIMAL SHELTER ADVISORY COMMITTEE Sec. 2.366. - Established; appointment; terms. The animal shelter advisory committee is established, in accordance with state law. The committee will consist of one licensed veterinarian, one city official, one person whose duties include the daily operation of an animal shelter, one representative from an animal welfare organization, one resident of the city or the city's extraterritorial jurisdiction, one person appointed by the City of Kyle, one person appointed by the City of Buda, and one person appointed by Hays County. With the exception of the persons appointed by the county, Buda, and Kyle, the committee will be appointed by the city council for staggered terms of three years. SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. 1
