ORDINANCE 2013 -11 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AMENDING CHAPTER 2, ARTICLE 3 — BOARDS, <br />COMMITTEES AND COMMISSIONS, DIVISION 18 -- ANIMAL <br />SHELTER ADVISORY COMMITTEE BY AMENDING SECTION 2.366 <br />OF THE SAN MARCOS CITY CODE TO ADD THE CITY OF BUDA AS <br />A MEMBER OF THE ANIMAL SHELTER ADVISORY COMMITTEE; <br />INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING AN <br />EFFECTIVE DATE. <br />RECITALS: <br />1 The San Marcos City Council entered into an interlocal agreement (" Agreement") with the <br />City of Buda, Texas on December 14; 2011, for the provision of animal shelter services to the City of <br />Buda relating to the proper care of animals, response to animal related issues and funding for said <br />services. <br />2. The Agreement authorizes a representative to the San Marcos Animal Shelter Advisory <br />Committee appointed by the Buda City Council. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. Chapter 2, Article 3 — Boards, Committees and Commissions, Division 18 — <br />Animal Shelter Advisory Committee, Section 2.66 of the San Marcos City Code is hereby amended to <br />read as follows (underlining indicates added text and strikethroughs indicate deleted text): <br />DIVISION 18. - ANIMAL SHELTER ADVISORY COMMITTEE <br />Sec. 2.366. - Established; appointment; terms. <br />The animal shelter advisory committee is established, in accordance with state law. The <br />committee will consist of one licensed veterinarian, one city official, one person whose duties <br />include the daily operation of an animal shelter, one representative from an animal welfare <br />organization, one resident of the city or the city's extraterritorial jurisdiction, one person <br />appointed by the City of Kyle, one person appointed by the City of Buda, and one person <br />appointed by Hays County. With the exception of the persons appointed by the county, Buda, <br />and Kyle, the committee will be appointed by the city council for staggered terms of three years. <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is <br />held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of <br />this ordinance will continue in force if they can be given effect without the invalid portion. <br />1 <br />
