<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
<br />OF SAN MARCOS, TEXAS, APPROVING THE PRICE AND
<br />CONDITIONS OF THE SALE BY THE CITY OF SAN
<br />MARCOS, TEXAS, OF LOT W OF BLOCK NO. SIX (6)
<br />OF THE B.W. BREEDING ADDITION TO THE CITY OF
<br />SAN ~ffiRCOS, HAYS COUNTY TEXAS, TO MICHAEL
<br />ARMSTEAD; AUTHORIZING THE MAYOR TO EXECUTE A
<br />WARRANTY DEED TO MICHAEL ARMSTEAD; AND DE-
<br />CLARING AN EMERGENCY.
<br />
<br />WHEREAS, the City of San Marcos, Texas, advertised for bids
<br />for the sale of that certain real property known as Lot W in Block
<br />No. six (6) of the B.W. Breeding Addition to the City of San Marcos,
<br />in Hays County, Texas, also known as Urban Renewal Parcel No. 38A-3,
<br />in the San Marcos Record, a local newspaper with a general circula-
<br />tion in the County of Hays, State of Texas, on December 14,1980
<br />and December 21,1980; and
<br />
<br />WHEREAS, pursuant to said advertisement a bid was submitted
<br />by Michael Armstead for said described property in the amount of
<br />two thousand five hundred dollars ($2,500.00); and,
<br />
<br />WHEREAS, said bid met the minimum disposition price set for
<br />said property by the Urban Renewal Board of Commissioners of the
<br />City of San Marcos, Texas on December 9; and
<br />
<br />WHEREAS, said Board accepted the bid as the highest and best
<br />responsible bid for said property on January 13, 1981; and
<br />
<br />WHEREAS, said Board recommends the approval of said purchase
<br />price and the approval of the terms and conditions for said sale,
<br />as contained in the bid document; now therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN ~ffiRCOS,
<br />TEXAS:

<br />SECTION 1. That the terms and conditions of the sale by the
<br />City of San Marcos, Texas, of Lot W in Block No. Six (6) of the B.
<br />W. Breeding Addition to the City of San Marcos, in Hays County,
<br />Texas, according to the map or plat thereof recorded in Volume "0",
<br />Page 202, of the Deed Records of Hays County, Texas, also known
<br />as Urban Renewal Parcel No. 38A-3, to Michael Armstead are hereby
<br />approved.

<br />SECTION 2. That the consideration of two thousand five hun~
<br />dYed dollars ($2,500.00) for said property be, and the same is hereby
<br />approved.
<br />
<br />SECTION 3. That the purchaser is hereby placed on notice that
<br />the subject property is subject to assessment under the provisions
<br />of Article 1105b, Texas Revised Civil Statutes.
<br />
<br />SECTION 4. That the mayor of the City of San Marcos, Texas,
<br />Kenneth V. Kraus be, and is hereby, authorized to execute a warranty
<br />deed to Michael Armstead from the City of San Marcos, for said
<br />property.
<br />
<br />SECTION 5. That the importance of this Ordinance creates an
<br />emergency and an imperative purpose necessary that the provisions
<br />of the charter requiring that ordinances shall be read on three
<br />separate meetings and that no ordinance shall become effective un-
<br />til the expiration of ten (10) days following the date of its final
<br />passage be suspended, and these provisions are hereby suspended,
<br />and this Ordinance shall take effect and be in full fórce and effect
<br />from and after its adoption and publication in a newspaper of general
<br />circulation within the City.
