<br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
<br /> OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL
<br /> ZONING MAP OF THE CITY BY ZONING LOTS 1-3,
<br /> BLOCK 10, FIRST SECTION-VICTORY GARDENS
<br /> SUBDIVISION OF THE CITY OF SAN MARCOS, HAYS
<br /> COUNTY, TEXAS, AS RECORDED IN VOLUME 128, PAGE
<br /> 46 OF THE HAYS COUNTY DEED RECORDS, LOCATED
<br /> AT 327 ROOSEVELT STREET FROM "M" SINGLE-
<br /> FAMILY, DUPLEX AND NEIGHBORHOOD BUSINESS
<br /> DISTRICT TO "R-1" SINGLE-FAMILY DWELLING
<br /> DISTRICT (LOW DENSITY) AND DECLARING AN
<br /> EFFECTIVE DATE.
<br /> WHEREAS, on October 1,1991, the Zoning commission of the City
<br /> of San Marcos held a public hearing regarding a request to change
<br /> the zoning from "M" (Single-Family, Duplex and Neighborhood
<br /> Business District) to "R-1" Single-Family Dwelling District (Low
<br /> Density) for Lots 1-3, Block 10, First Section-victory Gardens
<br /> Subdivision of the City of San Marcos, as recorded in Volume 128,
<br /> Page 46 of the Hays County Deed Records.
<br /> WHEREAS, subsequent to the public hearing on that date, the
<br /> Zoning commission did, on October 1, 1991 consider the request and
<br /> voted to approve it and has recommended that the request be
<br /> approved by the City Council of the city; and,
<br /> WHEREAS, the City Council held a public hearing on the 13th
<br /> day of January , 1992, regarding the request; and,
<br /> WHEREAS, all requirements of Appendix A, General Zoning
<br /> Ordinance, of the Code of Ordinances of the City of San Marcos
<br /> pertaining to amendments have been met; and,
<br /> WHEREAS, the City Council hereby finds and determines that the
<br /> adoption of the following ordinance is in the interest of the
<br /> public health, morals, welfare and safety; now, therefore,
<br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br /> TEXAS:
<br /> SECTION 1. That the Official Zoning Map of the City, as
<br /> described in section 3 of the General Zoning Ordinance is hereby
<br /> amended to rezone the following described real property located at
<br /> 327 Roosevelt Street in San Marcos, Hays County, Texas, mlich is
<br /> presently zoned "M" Single-Family, Duplex and Neighborhood Business
<br /> District, to "R-1" Single-Family Dwelling District (Low Density):
<br /> LOTS 1-3, BLOCK 10, FIRST SECTION-VICTORY GARDENS
<br /> SUBDIVISION OF THE CITY OF SAN MARCOS, HAYS COUNTY, TEXAS
<br /> AS RECORDED IN VOLUME 128, PAGE 46 OF THE HAYS COUNTY
<br /> DEED RECORDS.
<br /> SECTION 2. That this Ordinance shall be in effect ten (10)
<br /> days from and after its passage and after it has been subject to
<br /> reconsideration by the Council at its next regular meeting
<br /> following its passage, and providing that the Council did not vote
<br /> to reconsider it. If reconsidered on January 27, 1992 it shall be
<br /> in effect ten days from and after its passage on that date if
<br /> approved. It shall not go into effect if denied. If not
<br /> reconsidered and approved it shall be published in a newspaper of
<br /> general circulation in the area as required by the Charter of the
<br /> City of San Marcos, Texas.
<br /> PASSED, APPROVED AND ADOPTED this 13th day of January, 1992,
<br /> subject to reconsideration at the next regular city Council meeting
<br /> scheduled for January 27, 1992 .
