<br />86 <br /> <br />ORDn:IANCE NO. 1981-9R <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, APPROVING THE PRICE AND <br />CONDITIONS OF THE SALE BY THE CITY OF SAN MAR- <br />COS, TEXAS, OF LOT 5 AND A PART OF LOT 4 IN <br />BLOCK NO. THIRTY SIX (36) OF THE VICTORY GAR- <br />DENS TWO ADDITION TO THE CITY OF SAN MARCOS, <br />HAYS COUNTY, TEXAS, TO JOE GONZALES;AUTHORIZ- <br />ING THE MAYOR TO EXECUTE A WARRANTY DEED TO <br />JOE GONZALES;AND DECLARING AN EMERGENCY. <br /> <br />WHEREAS, the City of San Marcos, Texas, advertised for bids <br />for the sale of that certain real property known as Lot 5 and a <br />part of Lot 4 in Block No. thirty-six (36) of the Victory Gardens <br />Two Addition to the City of San Marcos, in Hays County, Texas, <br />also known as Urban Renewal Parcel No. 42R-4 & 5, in the San Marcos <br />Record, a local newspaper with a general circulation in the County <br />of Hays, State of Texas, on December 14, 1980 and December 21, 1980; <br /> <br />WHEREAS, pursuant to said advertisement a bid was submitted <br />by Joe Gonzales for said described property in the amount of four <br />thousand twenty five dollars ($4,025.00); and, <br /> <br />WHEREAS, said bid met the minimum disposition price set for <br />said property by the Urban Renewal Board of Commissioners of the <br />City of San Marcos, Texas, on December 9, 1980; and <br /> <br />WHEREAS, said Board accepted the bid as the highest and best <br />responsible bid for said property on January 13, 1981; and <br /> <br />WHEREAS, said Board recommends the approval of said purchase <br />price and the approval of the terms and conditions for said sale, <br />as contained in the bid document; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That the terms and conditions of the sale by the <br />City of San Marcos, Texas, of Lot 5 and a part of Lot 4 in Block <br />No. thirty-six (36) of the Victory Gardens Two Addition to the <br />City of San Marcos, in Hays County, Texas, also known as Urban <br />Renewal Parcel No. 42R-4 & 5, said tract being further described <br />by metes and bounds as follows: <br /> <br />BEGINNING, at the most eastern corner of Block No. <br />36, in the Second Section of Victory Gardens Addi- <br />tion in San Marcos, Hays County, Texas, same is shown <br />by the map or plat of the said addition now recorded <br />in Volume 130, Pages 148-152, of the Hays County Rec- <br />ords, and to which said map reference is here made; <br /> <br />THENCE, N 45° 40'W 85 feet along the southwest boundary <br />line of Nimitz Street to a point for corner, which cor- <br />ner is the most eastern and the beginning corner of the <br />tract herein conveyed; <br /> <br />THENCE, continuing N 450 40'W 40 feet along said south- <br />west boundary line of said Nimitz tract to a point for <br />corner which said corner is the most northern corner of <br />the tract of land herein conveyed; <br /> <br />THENCE, S44° 04'W 110 feet on a line parallel to the <br />northwest boundary line of Hines Street to a point for <br />corner, which said corner is the most western corner of <br />the tract of land herein conveyed; <br /> <br />THENCE, S 450 40'E 40 feet to a point for corner, which <br />said corner is the most southern corner of the tract of <br />land herein conveyed; <br /> <br />THENCE, N44° 04'E 110 feet to the PLACE OF BEGINNING. <br />
