J. - r;-- <br /> <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br /> SAN MARCOS, TEXAS, AMENDING SECTION 2-9 OF THE <br /> SAN MARCOS CODE OF ORDINANCES TO MORE CLEARLY <br /> DEFINE THE CITY MANAGER'S AUTHORITY TO MAKE <br /> PURCHASES ON BEHALF OF THE CITY AND TO AUTHORIZE <br /> THE CITY MANAGER TO PROMULGATE PURCHASING <br /> POLICIES AND PROCEDURES; PROVIDING FOR <br /> SEVERABILITY; REPEALING ALL CONFLICTING <br /> ORDINANCES AND RESOLUTIONS; PROVIDING A PENALTY; <br /> PROVIDING FOR PUBLICATION AND PROVIDING AN <br /> EFFECTIVE DATE. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. That Section 2-9 of the San Marcos Code of <br /> Ordinances is hereby amended to read as follows: <br /> Sec. 2-9. Authority of city manaqer to contract for <br /> expenditures not exceeding five thousand dollars <br /> and to enter into other aqreements. <br /> <br /> (a) The city manager is authorized to contract on behalf <br /> of the city for the purchase of goods and services without <br /> further council approval for all budgeted items not <br /> exceeding five thousand dollars ($5,000.00) in amount. <br /> (b) The city manager is authorized to promulgate <br /> purchasing policies and procedures for all purchases made <br /> by the city. The city manager may amend these policies <br /> from time to time. All such policies shall conform to <br /> applicable requirements of the City Charter, ordinances and <br /> state laws, and shall be subject to review and approval by <br /> the city attorney. <br /> (c) Lease agreements: <br /> (1) The city manager is hereby authorized to enter <br /> into lease agreements not in conflict with the <br /> City Charter, ordinances or state law, for the <br /> lease of city-owned real property for a term of <br /> fifteen (15) days or less for specific uses <br /> which will not result in permanent defacement, <br /> alteration, or damage to the subject property. <br /> (2) All leases authorized in subparagraph (1) above <br /> shall contain appropriate provisions relating to <br /> electrical inspection, fire inspections, health <br /> inspections, insurance coverage, and protection <br /> of the city from claims relating to the public <br /> health, welfare and safety. <br /> (d) Any contract entered into in violation of this section <br /> shall be voidable by the city council. <br /> SECTION 2. That if any word, phrase, clause, sentence, or <br /> paragraph of this ordinance is held to be unconstitutional or <br /> invalid by a court of competent jurisdiction, the remaining <br /> provisions of this ordinance shall remain in effect as if the <br /> unconstitutional or invalid portion had not been adopted. <br /> SECTION 3. That all ordinances and resolutions or parts of <br /> ordinances or resolutions in conflict herewith are hereby repealed. <br />
