J. - r;-- AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 2-9 OF THE SAN MARCOS CODE OF ORDINANCES TO MORE CLEARLY DEFINE THE CITY MANAGER'S AUTHORITY TO MAKE PURCHASES ON BEHALF OF THE CITY AND TO AUTHORIZE THE CITY MANAGER TO PROMULGATE PURCHASING POLICIES AND PROCEDURES; PROVIDING FOR SEVERABILITY; REPEALING ALL CONFLICTING ORDINANCES AND RESOLUTIONS; PROVIDING A PENALTY; PROVIDING FOR PUBLICATION AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That Section 2-9 of the San Marcos Code of Ordinances is hereby amended to read as follows: Sec. 2-9. Authority of city manaqer to contract for expenditures not exceeding five thousand dollars and to enter into other aqreements. (a) The city manager is authorized to contract on behalf of the city for the purchase of goods and services without further council approval for all budgeted items not exceeding five thousand dollars ($5,000.00) in amount. (b) The city manager is authorized to promulgate purchasing policies and procedures for all purchases made by the city. The city manager may amend these policies from time to time. All such policies shall conform to applicable requirements of the City Charter, ordinances and state laws, and shall be subject to review and approval by the city attorney. (c) Lease agreements: (1) The city manager is hereby authorized to enter into lease agreements not in conflict with the City Charter, ordinances or state law, for the lease of city-owned real property for a term of fifteen (15) days or less for specific uses which will not result in permanent defacement, alteration, or damage to the subject property. (2) All leases authorized in subparagraph (1) above shall contain appropriate provisions relating to electrical inspection, fire inspections, health inspections, insurance coverage, and protection of the city from claims relating to the public health, welfare and safety. (d) Any contract entered into in violation of this section shall be voidable by the city council. SECTION 2. That if any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the remaining provisions of this ordinance shall remain in effect as if the unconstitutional or invalid portion had not been adopted. SECTION 3. That all ordinances and resolutions or parts of ordinances or resolutions in conflict herewith are hereby repealed.
