<br /> 19 <br /> RESOLUTION 1992 - 12 R <br /> A RESOLUTION OF THE CITY COUNC IL OF THE CITY <br /> OF SAN MARCOS, TEXAS APPROVING THE TERMS AND <br /> CONDITIONS OF AN AGREEMENT BETWEEN THE CITY <br /> AND UNION PACIFIC RAILROAD COMPANY FOR A SEWER <br /> PIPELINE CROSSING LICENSE AGREEMENT~ <br /> AUTHORIZING THE CITY MANAGER TO EXECUTE THE <br /> AGREEMENT ON BEHALF OF THE CITY~ AND DECLARING <br /> AN EFFECTIVE DATE. <br /> WHEREAS, the City previously entered into a sewer pipeline <br /> crossing agreement with the Missouri Pacific Railroad Company, <br /> predecessor in interest to the Union Pacific Railroad Company (the <br /> "Railroad") on March 1, 1982, pertaining to Mile Post 988.47 in <br /> San Marcos, Texas~ and <br /> vÅ’EREAS, the City and the Railroad desire to renew this <br /> agreement on the terms and conditions described in the letter <br /> agreement attached to this reso1ution~ now, therefore <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. That the terms and conditions of the Agreement <br /> attached to this Resolution between the City and the Union Pacific <br /> Railroad Company for a sewer pipeline crossing license agreement <br /> pertaining to Mile Post 988.47 in San Marcos, Texas are hereby <br /> approved. <br /> PART 2. That the City Manager, Larry D. Gilley is hereby <br /> authorized to execute this Agreement on behalf of the City. <br /> PART 3. That this Resolution shall be in full forc e and <br /> effect immediately from and after its passage. <br /> ADOPTED this the lOthday of 'February , 192.2- <br /> ~o~.~ <br /> Mayor <br /> Attest: <br /> cf1f:f?~1~ <br /> City Secretary <br />
