<br /> 42 <br /> RESOLUTION NO. 1992 - 19R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS REQUESTING THE CITY BE ALLOWED TO <br /> PARTICIPATE IN THE PURCHASING PROGRAM OF THE STATE <br /> PURCHAS ING AND GENERAL SERVICES COMMISSION AND <br /> DECLARING AN EFFECTIVE DATE. <br /> WHEREAS, the City Council of the City of San Marcos, <br /> Texas pursuant to the authority granted by Subchapter D, <br /> Sections 271.ØSl-271.ØS3, Vernon's Annotated Texas Local <br /> Government Code, as amended, desires to participate in the <br /> purchasing program of the State Purchasing and General <br /> Services Commission¡ and, <br /> WHEREAS, the City Council of the City is of the opinion <br /> that participation in this program will be highly beneficial <br /> to the taxpayers of this City through the anticipated savings <br /> to be realized¡ now, therefore, <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS: <br /> PART 1. That the City of San Marcos, Texas, does hereby <br /> request the State Purchasing and General Services Commission <br /> to allow the City to participate in the Commission's <br /> purchasing program on a voluntary basis, and to the extent <br /> the Commission deems feasible. <br /> PART 2. That the City Manager, Larry D. Gilley, is <br /> hereby designated as the official to act for the City in all <br /> matters relating to the program, including the purchase of <br /> items from the vendor under any contract. <br /> PART 3. That the City Manager is hereby authorized and <br /> directed to sign and deliver all necessary requests and other <br /> documents in connection with the program for and on behalf of <br /> the City. <br /> PART 4. That the City will be responsible for <br /> submitting requisitions to the Commission under any contract <br /> and for payment directly to the vendor, and will be <br /> responsible for the vendor's compliance with all conditions <br /> of delivery and quality of any purchased item. <br /> PART 5.
