42 RESOLUTION NO. 1992 - 19R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS REQUESTING THE CITY BE ALLOWED TO PARTICIPATE IN THE PURCHASING PROGRAM OF THE STATE PURCHAS ING AND GENERAL SERVICES COMMISSION AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of San Marcos, Texas pursuant to the authority granted by Subchapter D, Sections 271.ØSl-271.ØS3, Vernon's Annotated Texas Local Government Code, as amended, desires to participate in the purchasing program of the State Purchasing and General Services Commission¡ and, WHEREAS, the City Council of the City is of the opinion that participation in this program will be highly beneficial to the taxpayers of this City through the anticipated savings to be realized¡ now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That the City of San Marcos, Texas, does hereby request the State Purchasing and General Services Commission to allow the City to participate in the Commission's purchasing program on a voluntary basis, and to the extent the Commission deems feasible. PART 2. That the City Manager, Larry D. Gilley, is hereby designated as the official to act for the City in all matters relating to the program, including the purchase of items from the vendor under any contract. PART 3. That the City Manager is hereby authorized and directed to sign and deliver all necessary requests and other documents in connection with the program for and on behalf of the City. PART 4. That the City will be responsible for submitting requisitions to the Commission under any contract and for payment directly to the vendor, and will be responsible for the vendor's compliance with all conditions of delivery and quality of any purchased item.
