<br />- <br />(!"' - <br />~ ~ 80 <br />- () <br />;0- <br /> <br />N <br /> <br /> <br />ORDINANCE 1991- 4 <br />-- <br />00- <br /><r <br />~ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />'6 OF SAN MARCOS, TEXAS, APPROVING THE PERMANENT <br />( CLOSURE OF PORTIONS OF FURMAN AVENUE, GIRARD <br />If AVENUE AND HAMILTON STREET BETWEEN HILLYER <br />STREET AND ADVANCE STREET; PROVIDING FOR <br />SEVERABILITY; REPEALING ALL CONFLICTING <br />ORDINANCES; PROVIDING FOR PUBLICATION AND <br />PROVIDING AN EFFECTIVE DATE. <br /> <br />WHEREAS, the Director of Public Works has submitted a request <br />to close the portions of Furman Avenue, Girard Avenue and Hamilton <br />Street between Hillyer Street and Advance Street indicated on the <br />map attached to this ordinance; and, <br /> <br />WHEREAS, the City Traffic Engineer and Director of Planning <br />and Developmental Services have reviewed and approved the request; <br />and, <br /> <br />WHEREAS, the owners of lots abutting the portions of streets <br />to be closed have been notified of the proposed action; and, <br /> <br />WHEREAS, the access to public streets of these lot owners will <br />not be substantially impaired by the street closure plan shown on <br />the attached map; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That the permanent closure of portions of Furman <br />Avenue, Girard Avenue and Hamilton Street between Hillyer Street <br />and Advance Street, as indicated on the map attached to this <br />ordinance, is hereby approved. <br /> <br />SECTION 2. That if any word, phrase, clause, sentence, or <br />paragraph of this ordinance is held to be unconstitutional or <br />invalid by a court of competent jurisdiction, the remaining <br />provisions of this ordinance shall remain in effect as if the <br />unconstitutional or invalid portion had not been adopted. <br /> <br />SECTION 3. That all ordinances and resolutions or parts of <br />ordinances or resolutions in conflict herewith are hereby repealed. <br /> <br />SECTION 4. That any person violating any provision of this <br />ordinance shall be deemed guilty of a misdemeanor and upon <br />conviction shall be subject to the penalty provided in section 1-5 <br />of the San Marcos Code of Ordinances. <br /> <br />SECTION 5. That this Ordinance shall be in effect ten (10) <br />days from and after its passage, and it shall be published in a <br />newspaper of general circulation in the area as required by the <br />Charter of the City of San Marcos, Texas. <br /> <br />PASSED AND APPROVED on first reading January 14, 1991. <br /> <br />PASSED AND APPROVED on second reading January 28, 1991. <br /> <br />PASSED, APPROVED AND ADOPTED February 11, 1991. <br /> <br /> <br />Att~sw~~ ¡1fðJ) M~i,S~ <br />J1d K.
