<br />- 92 <br />r' <br />0- <br /> <br />- <br />- <br /> <br />~ ORDINANCE 1991- 7 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING CHAPTER 25 - STREETS AND <br />- SIDE\vALKS OF THE SAN MARCOS CODE OF ORDINANCES BY <br />~ ADDING SECTIONS 25-8 AND 25-9 TO ESTABLISH POLICIES <br />-- FOR STREET NAME CHANGES \VITHIN THE CITY: AMENDING <br />~ APPENDIX C - SUBDIVISIONS OF THE SAN MARCOS CODE OF <br />1"\1 ORDINANCES TO ESTABLISH ADDITIONAL CRITERIA FOR <br />NAMING NEW STREETS, PROVIDING FOR SEVERABILITY: <br />REPEALING ALL CONFLICTING ORDINANCES: PROVIDING FOR <br />PUBLICATION AND PROVIDING AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City Council of the City of San Marcos <br />recognizes that street name changes are both costly and time <br />~ consuming for residents, businesses and property owners: and, <br />r <br />~ WHEREAS, no formal policy has previously been <br />~ adopted for the facilitation of street name changes: and, <br /> <br />WHEREAS, there is a need for the adoption of a <br />formal policy to facilitate street name changes: now, <br />therefore, <br /><tT" <br />!: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />- TEXAS: <br />f'.J <br />rl <br />SECTION 1. That Chapter 25 - Streets and Sidewalks <br />of the San Marcos Code of Ordinances is amended to add <br />Sections 25-8 and 25-9 to read as follows: <br /> <br />Sec. 25~8. Street name changes - Initiation by <br />petition. <br /> <br />(a) A change in the name of a public street within <br />the city may be initiated by a citizen petition. The <br />peti tion shall be in a form prescribed by the Director of <br />Planning and Development Services. <br /> <br />(b) The petition shall be considered initially by <br />the planning commission, and shall be considered only if more <br />than fifty percent (5Ø%) of the business owners and more than <br />fifty percent (5Ø%) of the property owners located along the <br />street in question, insofar as they can reasonably be <br />determined, have signed the petition in favor of the change. <br /> <br />(c) In considering the petition, the planning <br />commission shall conduct a public hearing, and shall apply <br />the following criteria: <br /> <br />(1) Multiple names along the continuity of a <br />single street, or along two streets that are in substantial <br />alignment, shall be avoided: <br /> <br />(2) Consideration shall be given to <br />historical and geographical significance of a street or area <br />or to the recognition of a significant personal achievement: <br /> <br />(3) A new street name shall not duplicate, or <br />sound phonetically similar to, the name of a street already <br />in use in the city or the city's extraterritorial <br />jurisdiction or designated as a future extension in the <br />current thoroughfare plan: <br /> <br />(4) A new street name shall not differ from <br />an existing street name only by the addition of a different <br />auxiliary designation such as "Avenue," "Way," "Boulevard," <br />etc.: and <br /> <br />(5) The planning commission shall also review <br />any other pertinent criteria in its consideration of a street <br />name change. <br /> <br />(d) Notice of the public hearing by the planning <br />commission shall be given by publication one time in a <br />newspaper of general circulation in the city, and by first <br />class mail to all business owners and property owners along <br />
