<br /> 107 <br /> RESOLUTION 1991- 25 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br /> OF SAN MARCOS, 'l'EXAS, APPROVING AN AMENDMENT <br /> TO THE TAX Þ~BATEMENT AGREEMENT BETWEEN THE <br /> CITY AND HARPER'S HALL JOINT VENTURE; <br /> AUTHORIZING THE CITY MANAGER TO EXECUTE THE <br /> AMENDMENT AND DECLARING AN EFFECTIVE DATE. <br /> WHEREAS, the Harper's Hall Joint Venture executed a tax <br />abatement agreement with the City of San Marcos dated May 23,1989, <br />pertaining to its development of property included in San Marcos <br />Reinvestment Zone No.3; and, <br /> WHEREAS, the legal description of property attached to that <br />agreement was incorrect since it covered only one of the two <br />adjacent parcels that the parties intended to cover under the <br />agreement; and, <br /> WHEREAS, the City and Harper's Hall Joint Venture desire to <br />correct this error through a clarifying amendment to the agreement; <br />now, therefore, <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> PART I. That Amendment No.1 to the Tax Abatement Agreement <br />between the City of San Marcos and Harper's Hall Joint venture, a <br />copy of which is attached to this Resolution, is hereby approved <br />and adopted. <br /> PART 2. That the City Manager of the City of San Marcos, <br />Larry D. Gilley, is authorized to execute the Amendment. <br /> PART 3.
