97 R"('or.TTTlmJ J C¡Qr\- 22..... R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING AN AMENDMENT TO THE AGREEMENT WITH BRmi7NING-FERRIS, INC. TO INCREASE THE BASE RESIDENTIAL SOLID WASTE COLLECTION RATE, AUTHORIZING THE CITY MANAGER TO EXECUTE AN ADDENDUM FOR THIS PURPOSE, AND DECLARING AN EFFECTIVE DATE. vilHE REAS, the City of San Marcos entered into an agreement with Browning-Ferris, Inc. on April 11, 1983 for solid waste collection and disposal and related services; and, WHEREAS, this agreement provides for unit price adjustments on the basis of additional duties and responsibilities imposed upon Browning- Ferris, Inc. by changes or additions to laws, ordinances, rules or regulations; and, WHEREAS, increased governmental regulations have imposed additional duties and responsibilities upon Browning-Ferris, Inc. in the performance of this agreement and warrant an increase of $.063 in the Base Residential Rate of the agreement, bringing the total rate to $5.463 per month; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART I. That an amendment to the agreement between the City of San Marcos and Browning-Ferris, Inc. to increase the monthly Base Residential Rate of the agreement by $.063 to $5.463 per month is hereby approved. PART 2. That the City Manager, Larry Gilley, is hereby authorized to execute Amendment Number Three to this agreement on behalf of the City of San Marcos, in the form attached hereto as Exhibit "All. PART 3. That this Resolution shall be in full force and effect from and after its passage. ADOPTED this 7th day of March œI~ .
