<br /><:::) 128 <br />~ <br />- <br />...... <br />~ ORnnfí\HCE 1990- 23 <br /> <br />E <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF <br />THE CITY BY ZONING 0.306 ACRES, MORE OR LESS, OF LAND IN <br />THE CITY OF SAN MARCOS, AS RECORDED IN VOLUME 300, PAGES <br />499 THROUGH 501 OF THE HAYS COUNTY DEED RECORDS, LOCATED <br />AT THE NORTH CORNER OF EAST BUGG LANE AND THORPE LANE <br />FROM "M" (SINGLE-FAMILY, DUPLEX AND NEIGHBORHOOD BUSINESS <br />DISTRICT) TO "C" (COMMERCIAL DISTRICT) AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br /> <br />WHEREAS, on December 5, 1989, the Zoning Commission of the City <br />of San Marcos held a public hearing regarding a request to <br />change the zoning from II Mil (Single-Family Duplex and Neighborhood <br />Business District) to "c" (Commercial District) of 0.306 acres, more or <br />less, of land in the City of San Marcos, located at the North Corner <br />of East Bugg Lane and Thorpe Lane, San Marcos, Texas; and, <br /> <br />WHEREAS, subsequent to the public hearing on that date, the <br />Zoning Commission did, on December 5, 1989, consider the request and <br />voted to approve the same and has recommended that such <br />request be approved by the City Council of the <br />City; and, <br /> <br />WHEREAS, the City Council held a public hearing on the 9th day <br />of April, 1990, regarding such request; and, <br /> <br />WHEREAS, all requirements of Appendix A, General Zoning <br />Ordinance, of the Code of Ordinances of the City of San Marcos <br />pertaining to amendments have been met; and, <br /> <br />WHEREAS, the City Council hereby finds and determines that the <br />adoption of the following ordinance is in the interest of the public <br />health, morals, welfare and safety; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. That the Official Zoning Map of the City, as described <br />in Section 3 of the General Zoning Ordinance, is hereby amended to <br />rezone the following described real property located in San Marcos, <br />Hays County, Texas, which is presently zoned "M" (Single-Family, Duplex <br />and Neighborhood Business District) to "c" (Commerc ial District) : <br /> <br />BEGINNING at an iron stake set on the North line of Bugg Lane <br />for the South corner of the tract herein described same being <br />the South corner of the said Carson tract and from which <br />beginning corner the intersection of the North line of Bugg <br />Lane and the Northwest line of Thorp Lane bears S. 79 degrees <br />14' E. 18.31 feet; <br /> <br />THENCE, with the North line of Bugg Lane and the South line of <br />the said Carson tract N. 79 degrees 14' W. 103.56 feet to an <br />iron stake set for the West corner of the tract herein <br />described, same being the West corner of the said Carson tract; <br /> <br />THENCE, leaving the North line of Bugg Lane with the Northwest <br />line of the said Carson tract N. 45 degrees 42' E. 186.32 feet <br />to an iron stake set for the North corner of the tract herein <br />described, same being the North corner of the said Carson <br />tract; <br /> <br />THENCE, with the Northeast line of the said Carson tract, S. 44 <br />degrees 15' E. 85.0 feet to an iron stake set for the East <br />corner of the tract herein described same being the East corner <br />of the said Carson tract; <br /> <br />THENCE, with the Southeast line of the said Carson tract, S. 45 <br />degrees 45' W. 126.94 feet to the Place of Beginning, <br />containing 0.31 acres of land. <br /> <br /> <br />SECTION 2. That this Ordinance shall be in effect ten (10) days <br />from and after its passage and after it has been subject to <br />reconsideration by the Council at its next regular meeting following <br />
