<br /> <br /> <br /> <br />18 <br /> <br />ORDINANCE 1989-1 <br /> <br />AN ORfHt\TJ'..NCE OF THE CITY COf1NCI L OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINJ'..NCE <br />WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF <br />BUILDINGS, STRUCTURES AND LAND, DATED JUNE 13, 1984 <br />(VOL. 66) BY ZONING 3.35 ACRES BEING THAT PORTION OF <br />13 LOTS IN THE SOUTH PARK COMMERCIAL SUBDIVISION, TO THE <br />CITY OF SAN MARCOS, TEXAS, LOCATED ALONG THE NORTHWEST <br />SIDE OF IH-35 SOUTH BETWEEN CENTERPOINT ROAD AND POSEY <br />ROAD FROM IIARII (AGRICULTURAL-RANCH DISTRICT) TO "LI" <br />(LIGHT INDUSTRIAL DISTRICT) AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />WHEREAS, on October 18, 1988, during the Joint Planning and <br />Zoning Commission meeting of the City of San Marcos a public hearing <br />was held regarding a request to change the zoning from "ARII <br />(Agricultural-Ranch District) to IILIII (Light Industrial District) of <br />3.35 acres being that portion of 13 lots in the South Park <br />Commercial Subdivision to the City of San Marcos, Hays County, Texas: <br />and, <br /> <br />WHEREAS, subsequent to said public <br />Zoning Commission did, on October 18, 1987, <br />vote to approve the same and has <br />request be approved by the City <br />Ci ty: and, <br /> <br />hearing on said date, said <br />consider said request and <br />recommended that such <br />Council of said <br /> <br />of <br /> <br />WHEREAS, said City Council held a public hearing on the <br />January , 198~, regarding such request: and, <br /> <br />9 <br /> <br />day <br /> <br />WHEREAS, all requirements of Appendix A, General Zoning <br />Ordinance, of the Code of Ordinances of the City of San Marcos <br />pertaining to amendments have been met: and, <br /> <br />WHEREAS, said City Council hereby finds and determines that the <br />adoption of the following ordinance is in the interest of the public <br />health, morals, welfare and safety: new, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> <br />SAN <br /> <br />MARCOS, <br /> <br />TEXAS: <br /> <br />SECTION I. That the following described tracts of real property <br />located in San Marcos, Hays County, Texas, which is presently <br />zoned liAR II (Agricultural-Ranch District) be rezoned to "LI" (Light <br />Industrial District): <br /> <br />Beginning at a point on the Northwest Right of Way line of <br />Interstate Highway No. 35, same being the East corner of the <br />South Park Commercial Subdivision, marked by an iron rod, <br /> <br />THENCE South 44 degrees 08'0011 West 1389.45' to the South corner <br />of said subdivision, an iron rod, <br /> <br />THENCE North 45 degrees 20'1211 West 105.0' to a calculated point <br />on the Southwest line of said subdivision, <br /> <br />THENCE North 44 degrees 08'00" East 1389.86' to a <br />point on the Northeast line of said subdivision, <br /> <br />calculated <br /> <br />THENCE South 44 degrees 57'27" East 105.0' <br />Beginning enclosing an area of + 3.35 acres. <br /> <br />to the Point of <br /> <br />SECTION 2. That this Ordinance shall be in effect ten (10) days <br />from and after its passage and after it has been subject to <br />reconsideration by the Council at its next regular meeting following <br />its passage, and providing that the Council did not vote to reconsider <br />it. If reconsidered on January 23, 1989, it shall be in effect ten <br />days from and after its passage on that date if approved. It shall not <br />go into effect if denied. If not reconsidered or if reconsidered and <br />approved it shall be published in a newspaper of general circulation in <br />the area as required by the Charter of the City of San Marcos, Texas. <br /> <br />PASSED, APPROVED AND ADOPTED this <br />subject to reconsideration at the next <br />scheduled for January 23, 1989 <br /> <br />9 day of January <br />regular City Council <br /> <br />,1989, <br />meeting <br /> <br />Reconsidered <br /> <br />yes <br /> <br />no X <br />
