47 RESOLUTION 1989-11R A RESOLUTION OF THE Crry COUNCIL. OF THE CITY OF SAN MARCOS, TEXAS APPROVING CHANGE ORDER NO.1 INCREASING THE CONTRACT TIME AND AMOUNT OF THE EAS'r BUGG LANE PAVING AND DRAINAGE IMPROVEMENTS PROJECT, AUTHORIZING THE CITY MANAGER TO EXECUTE SAID CHANGE ORDER ON BEHALF OF SAID CITY AND DECLARING AN EFFECTIVE DATE. WHEREAS, by execution of an owner-contractor agreement on December 7, 1988, the City of San Marcos, Texas and Du-Mor Enterprises entered into an agreement for the construction of the East Bugg Lane Paving and Drainage Improvements project: and, WHEREAS, the City of San Marcos desires to extend a water line beyond the scope of work of said owner-contractor agreement and Du-Mor Enterprises has agreed to perform said additional services; and, WHEREAS, the said additional services require an increase in the contract amount over $5,000.00 but which is less than 25% of the total contract amount, and an increase in the contract time: now, therefore: BE IT RESOLVED BY THE CITY COUNCIL OF 'fHE Crry OF SAN MARCOS, TEXAS: PART 1. That the terms and conditions of Change Order No.1 to that contract for construction of the East Bugg Lane Paving and Drainage Improvements between the City of San Marcos, Texas and Du-Mor Enterprises, a copy of said change order being attached hereto and incorporated herein, are hereby approved. PART 2. That the City Manager, Larry D. Gilley, be and he is hereby authorized to execute said Change Order on behal f of said City. PART 3.
