<br />138 <br /> <br /> <br />q~ ORDINANCE 1989-11 <br /> <br />NT ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING CHAPTER 14 OF THE CODE OF <br />ORDINANCES OF SAID CITY TO ADOPT THE 1988 EDITION OF <br />THE STANDARD HOUSING CODE AND SUBSEQUENT REVISIONS <br />THERETO, AND DECLARING AN EFFECTIVE DATE. <br /> <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. That Section 14-1 of Chapter 14 of the Code of <br />Ordinances of the City of San Marcos, Texas, is hereby amended to read <br />as follows: <br /> <br />Sec. 14-1. Housing Code Adopted. <br /> <br />There is hereby adopted by the City of San Marcos, Texas, for <br />the purpose of providing the basic minimum housing standards <br />deemed essential for safe and healthful living and the minimum <br />requirements necessary to maintain any residential occupancy in <br />a safe and sanitary condition within the corporate limits of the <br />City of San Marcos, Texas, that certain housing code known as <br />the Standard Housing Code, 1988 edition, published by the <br />Southern Building Code Congress International Inc., 900 <br />Montclair Road, Birmingham, Alabama 35213-1206, now and as <br />amended, of which a copy has been and now is filed in the Office <br />of the City Secretary of the City of San Marcos, and <br />incorporated as fully as if set out herein. <br /> <br /> <br />SECTION 2. That Section 14-3 of ~aid Code of Ordinances is <br />amended to read as follows~ <br /> <br />Sec. 14-3. Amendments. <br /> <br />The 1988 edition of the Standard Housing Code is amended and <br />changed in the following respects: <br /> <br /> <br />. . . <br /> <br /> <br />(b) Section 106.1.1 <br /> <br />The Building Board of Adjustments and Appeals established <br />in Section 5-29 of the Code of Ordinances of the City of <br />San Marcos, shall govern with regard to provisions <br />contained within this Code. <br /> <br />(c) Sections 106.1.2 and 106.2 are repealed. References in <br />Sections 106.3, 106.4, 106.5, 106.6 and 107 to the housing <br />board of adjustments and appeals are changed to the <br />building board of adjustments and appeals. <br /> <br />(d) Section 108 is repealed. <br /> <br />(e) New Section 108 is adopted to read as follows: <br /> <br />108. Penalties and violations. <br /> <br />Any person, firm, corporation or agent who shall violate <br />a provision of this code or fail to comply with it or any <br />of its requirements shall be guilty of a misdemeanor. <br />Each person, firm, corporation or agent shall be deemed <br />guilty of a separate offense for each and every day or <br />portion of a day during which any violation of any of the <br />provisions of this code is committed or continued. Upon <br />conviction of a violation of this code, the defendant <br />shall be punished by a fine of two hundred dollars <br />($200.00) to one thousand dollars ($1,000.00). <br />Prosecution or conviction under this provision shall never <br />be a bar to any other remedy or relief for violation of <br />this code. <br /> <br /> <br />SECTION 3. That this Ordinance shall be in effect ten (10) days <br />from and after its passage, and it shall be published in a newspaper of <br />general circulation in the area as required by the Charter of the City <br />of San Marcos. <br />
