138 q~ ORDINANCE 1989-11 NT ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING CHAPTER 14 OF THE CODE OF ORDINANCES OF SAID CITY TO ADOPT THE 1988 EDITION OF THE STANDARD HOUSING CODE AND SUBSEQUENT REVISIONS THERETO, AND DECLARING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That Section 14-1 of Chapter 14 of the Code of Ordinances of the City of San Marcos, Texas, is hereby amended to read as follows: Sec. 14-1. Housing Code Adopted. There is hereby adopted by the City of San Marcos, Texas, for the purpose of providing the basic minimum housing standards deemed essential for safe and healthful living and the minimum requirements necessary to maintain any residential occupancy in a safe and sanitary condition within the corporate limits of the City of San Marcos, Texas, that certain housing code known as the Standard Housing Code, 1988 edition, published by the Southern Building Code Congress International Inc., 900 Montclair Road, Birmingham, Alabama 35213-1206, now and as amended, of which a copy has been and now is filed in the Office of the City Secretary of the City of San Marcos, and incorporated as fully as if set out herein. SECTION 2. That Section 14-3 of ~aid Code of Ordinances is amended to read as follows~ Sec. 14-3. Amendments. The 1988 edition of the Standard Housing Code is amended and changed in the following respects: . . . (b) Section 106.1.1 The Building Board of Adjustments and Appeals established in Section 5-29 of the Code of Ordinances of the City of San Marcos, shall govern with regard to provisions contained within this Code. (c) Sections 106.1.2 and 106.2 are repealed. References in Sections 106.3, 106.4, 106.5, 106.6 and 107 to the housing board of adjustments and appeals are changed to the building board of adjustments and appeals. (d) Section 108 is repealed. (e) New Section 108 is adopted to read as follows: 108. Penalties and violations. Any person, firm, corporation or agent who shall violate a provision of this code or fail to comply with it or any of its requirements shall be guilty of a misdemeanor. Each person, firm, corporation or agent shall be deemed guilty of a separate offense for each and every day or portion of a day during which any violation of any of the provisions of this code is committed or continued. Upon conviction of a violation of this code, the defendant shall be punished by a fine of two hundred dollars ($200.00) to one thousand dollars ($1,000.00). Prosecution or conviction under this provision shall never be a bar to any other remedy or relief for violation of this code. SECTION 3. That this Ordinance shall be in effect ten (10) days from and after its passage, and it shall be published in a newspaper of general circulation in the area as required by the Charter of the City of San Marcos.
