11 ORDINANCE 1989-19 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING CHAPTER 20, ENTITLED, PLUMBING AND GAS, OF THE SAN MARCOS CODE OF ORDINANCES BY ADOPTING THE 1988 EDITION OF THE STANDARD PLUMBING CODE, LOCAL AMENDMENTS THERETO AND THE 1989 REVISIONS THERETO, AND DECLARING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That Article II of Chapter 20 of the San Marcos Code of Ordinances is amended to read as follows: ARTICLE II PLUMBING PERTAINING TO WATER AND SEWER SYSTEMS Sec. 20-1. Plumbing Code Adopted. The Standard Plumbing Code published in 1988 by the Southern Building Code Congress International, Inc. 900 Montclair Road, Birmingham, Alabama 35213-1206 as amended in this Article and the 1989 revisions thereto shall regulate installation, alterations, repairs, and replacement of plumbing in the City and its extraterritorial, jurisdiction. A copy of the code is filed in the office of the City Secretary of the City of San Marcos, and the same is hereby adopted and incorporated as fully as if set out herein. Sec. 20-2. Amendments to Standard Plumbing Code. . . . (d) Section 103.1 is amended.to read as follows: Section 103.1 Licensinq of persons installing plumbing. . . . (c) Plumbing work may be done without a license as permitted by the Plumbing License Act, Tex. Rev. Civ. Stat. Ann. Art. 6243-101, 3 (Vernon 1989), however a permit must be obtained, fees paid and all other provisions of this code except as provided in AI03.1.3 must be met. . . . (g) Section 1210 is amended by the addition of Section 12l0.1.2(a) as follows: 1210.l.2(a) materials- Polybutylene (PB) plastic pipe or tubing shall not be used under slabs or inside structures on new construction. It may be used to repair existing systems consisting of polybutylene materials. SECTION 2. That all references to the 1985 edition of the Standard Plumbing Code in Article II of Chapter 20 of the San Marcos Code of Ordinances are hereby replaced with the 1988 edition of the Standard Plumbing Code. SECTION 3. That this Ordinance shall be in effect ten (10) days from and after its passage, and it shall be published in a newspape~ of general circulation in the area as required by the Charter of the City of San Marcos.
