<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, ANNEXING TO SAID CITY A TRACT OF
<br />LAND CONTAINING 110 . '8-59 ACRES, MORE OR L"ESS,
<br />FRONTING ON THE SOUTHEAST RIGHT-OF-WAY LINE OF
<br />INTERSTATE HIGHWAY 35 IN HAYS COUNTY, TEXAS, SAID
<br />LAND BEING LOCATED WITHIN THE EXTRATERRITORIAL
<br />JURISDICTION OF SAID CITY AND LYING ADJACENT TO
<br />PRESENT CITY BOUNDARIES; APPROVING A SERVICE PLAN
<br />FOR SAID TRACT; EXTENDING THE BOUNDARY LIMITS OF
<br />SAID CITY SO AS TO INCLUDE SAID TRACT-; GRANT-ING TO
<br />THE INHABITANTS OF SAID TRACT ALL THE RIGHTS AND
<br />PRIVILEGES OF OTHER CITIZENS OF SAID CITY; BINDING
<br />SAID INHABITANTS BY ALL OF THE ACTS AND ORDINANCES,
<br />RULES AND REGULATIONS OF SAID CITY; AND DECLARING
<br />AN EFFECTIVE DATE.

<br />
<br />WHEREAS, the City Council of the City of San Marcos, Texas,
<br />provided an opportunity for all interested persons to be heard at two
<br />(2) public hearings, held once on April 7, 1989 , and
<br />once on April 10, 1989 , to consider the proposed
<br />annexation by the City of San Marcos, Texas of 110.859 acres, more or
<br />less, of land fronting on the southeast right-of-way line of
<br />Interstate Highway 35, Hays County, Texas, and being more particularly
<br />described by metes and bounds in attached Exhibit A; and,
<br />
<br />WHEREAS, an on-site public hearìng has not been requested in
<br />writing by more than 20 adults residing in said area; and,
<br />
<br />WHEREAS, notices of said public hearings were published in the
<br />San Marcos Daily Record, a newspaper having general circulation in
<br />said City and in the territory proposed for annexation,
<br />on March 24, 1989 , and March 26, 1989 , said dates
<br />being not more than twenty (20) days nor less than ten (10) days prior
<br />to the hearings for which notices were given; and,
<br />
<br />WHEREAS, prior to the publication of notices of said hearings,
<br />the City Council of the City of San Marcos, Texas directed preparation
<br />of a service plan that provides for the extension of municipal
<br />services to said area proposed for annexation; and,
<br />
<br />WHEREAS, said proposed service plan was made available for
<br />inspection and explained to the inhabitants of the area to be annexed
<br />at said public hearings; and,
<br />
<br />WHEREAS, said 110.859 acre tract is contiguous and adjacent to
<br />the current boundaries of the City of San Marcos, Texas; now,
<br />therefore,

<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br />TEXAS:

<br />SECTION 1. That that property more particularly described in
<br />Exhibit A which is attached hereto and incorporated herein for all
<br />purposes, being 110.859 acres of land adjoining the existing city
<br />limits of the City of San Marcos, Texas, fronting on the southeast
<br />right-of-way line of Interstate Highway 35, Hays County, Texas, be,
<br />and the same is hereby, annexed to the City of San Marcos, Texas.
<br />
<br />SECTION 2. That the Service Plan for said area, a copy of which
<br />is attached hereto as Exhibit B and incorporated herein for all
<br />purposes, be, and the same is hereby, approved.
<br />
<br />SECTION 3. That the corporate limits of said City be, and the
<br />same are hereby, extended to include said described territory.
<br />
<br />SECTION 4. That said described territory shall henceforth be a
<br />part of the City of San Marcos, Texas, and any inhabitants thereof
<br />shall be entitled to all the rights and privileges of all citizens,
<br />and shall be bound by the acts, ordinances, resolutions and
<br />regulations of said City.

<br />SECTION 5. That this Ordinance shall be in effect ten (10) days
<br />from and after its passage, and it shall be published in a newspaper
<br />of general circulation in the area as required by the Charter of the
<br />City of San Marcos, Texas.
