<br /> <br /> <br /> <br />5. <br /> <br />ORDINANCE 2001- 40 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, CANVASSING RETURNS AND <br />DECLARING RESULTS OF THE RUNOFF SPECIAL <br />ELECTION HELD ON JUNE 2,2001 FOR THE PURPOSE OF <br />ELECTING A CITY COUNCIL MEMBER, PLACE 2; AND <br />DECLARING AN EMERGENCY. <br /> <br />RECITALS: <br /> <br />1. The City Council ordered that a Runoff Special Election be held on June 2, 2001 for <br />the purpose of electing a Council Member, Place 2. <br /> <br />2. Notice of this election was duly published in the San Marcos Daily Record on May <br />20,2001. <br /> <br />3. A copy of the notice was posted on the bulletin board at City Hall on May 10, 2001. <br /> <br />4. This election was duly and legally held on the 2nd day of June, 2001, in conformity <br />with the election laws of the State of Texas, and the results of the election have been <br />certified and returned by the proper judges and clerks. <br /> <br />5. The City Council of the City of San Marcos, Texas with the following members <br />present: Ed Mihalkanin, Earl Moseley, Jr., Jane Hughson, Joe Cox, Jr., Paul Mayhew <br />Martha Tatum and David Chiu has today considered the returns of <br />the Runoff Special Election held on the 2nd day of June, 2001. <br /> <br />6. It appears to the Council, and the Council finds, that the election was in all respects <br />lawfully held. <br /> <br />7. It appears to the Council, and Council finds, that the tabulation of the results of the <br />election is correct. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Runoff Special Election of June 2,2001 was duly called, notice <br />of the election was given in accordance with law, and the election was held in accordance <br />with law. <br /> <br />SECTION 2. The tabulation of votes cast in the Runoff Special election held on <br />June 2,2001 for the purposes stated in recital 1 above, a copy of which is attached to and <br />made a part of this ordinance, is adopted as the official tabulation of the votes cast at the <br />election, and the tabulation will be filed and recorded in the official records of the City of <br />San Marcos as the official canvass of the election. <br />
