The City Council is authorized under Section 41.0052(a) of the Texas Election Code to, <br />not later than December 31, 2004, change the date on which the City holds its general election for <br />officers from one authorized uniform election date to another authorized uniform election date. <br /> <br />2. The date for regular City elections is presently set in Section 5.01 of the City Charter <br />provides as the "second uniform election date ofthe calendar year as provided by state law," which is <br />the first Saturday in May under Texas Election Code Section 41.001(a). <br /> <br />3. The City Council wishes to change the date for regular City elections to the fourth <br />authorized uniform election date in each calendar year, which is the first Tuesday after the first <br />Monday in November under Texas Election Code Section 41.001(a). <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The date for regular City elections is changed from the second uniform <br />election date of each calendar year to the fourth authorized uniform election date in each calendar <br />year. <br /> <br />SECTION 2. Pursuant to Section 41.0052(b) of the Election Code, the terms of office of <br />city council members that would normally expire in May of2005 will expire instead in November, <br />2005. The terms of office of city council members that would normally expire in May of2006 will <br />expire instead in November, 2006. The terms of office of city council members that would normally <br />expire in May of2007 will expire instead in November, 2007. <br /> <br />SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to <br />be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in force if they can be given effect without the invalid portion. <br /> <br />SECTION 4. All ordinances and resolutions or parts of ordinances or resolutions in conflict <br />with this ordinance are repealed. <br /> <br />SECTION 5. This Ordinance will take effect ten days after the date of its final passage, and <br /> <br />-1- <br />
