ORDINANCE NO. 2004- 93 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, CHANGING THE DATE FOR REGULAR CITY ELECTIONS FROM THE SECOND UNIFORM ELECTION DATE IN EACH CALENDAR YEAR TO THE FOURTH UNIFORM ELECTION DATE IN EACH CALENDAR YEAR; AND INCLUDING PROCEDURAL PROVISIONS. The City Council is authorized under Section 41.0052(a) of the Texas Election Code to, not later than December 31, 2004, change the date on which the City holds its general election for officers from one authorized uniform election date to another authorized uniform election date. 2. The date for regular City elections is presently set in Section 5.01 of the City Charter provides as the "second uniform election date ofthe calendar year as provided by state law," which is the first Saturday in May under Texas Election Code Section 41.001(a). 3. The City Council wishes to change the date for regular City elections to the fourth authorized uniform election date in each calendar year, which is the first Tuesday after the first Monday in November under Texas Election Code Section 41.001(a). BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The date for regular City elections is changed from the second uniform election date of each calendar year to the fourth authorized uniform election date in each calendar year. SECTION 2. Pursuant to Section 41.0052(b) of the Election Code, the terms of office of city council members that would normally expire in May of2005 will expire instead in November, 2005. The terms of office of city council members that would normally expire in May of2006 will expire instead in November, 2006. The terms of office of city council members that would normally expire in May of2007 will expire instead in November, 2007. SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 4. All ordinances and resolutions or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 5. This Ordinance will take effect ten days after the date of its final passage, and -1-
