ORDINANCE NO. 2022-22 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AMENDING REGULATIONS AND STANDARDS <br />APPLICABLE WITHIN THE TRACE PLANNED DEVELOPMENT <br />DISTRICT CONSISTING OF APPROXIMATELY 417.63 ACRES OF <br />LAND GENERALLY LOCATED AT 5818 SOUTH OLD BASTROP <br />HIGHWAY, TO, AMONG OTHER THINGS, UPDATE PROVISIONS <br />CONCERNING DOCUMENT ILLUSTRATIONS, THE ZONING <br />CONCEPT PLAN, PUBLIC SPACE, CIRCULATION AND <br />CONNECTIVITY, SITE DESIGN, ARCHITECTURAL DESIGN, <br />SIGNAGE, AND APPENDIXES; INCLUDING PROCEDURAL <br />PROVISIONS; AND PROVIDING AN EFFECTIVE DATE. <br />RECITALS: <br />1. On February 8, 2022, the City Planning and Zoning Commission of the City of San <br />Marcos held a public hearing concerning a request to amend certain regulations and standards <br />applicable within the Trace Planned Development District consisting of approximately 417.63 <br />acres of land generally located at 5818 South Old Bastrop Highway, as approved by Ordinance <br />No. 2015-42, and previous amendments thereto. <br />2. Subsequent to the public hearing, the Planning and Zoning Commission considered <br />the request and made a recommendation to the City Council. <br />3. The City Council held a public hearing on March 1, 2022, regarding the request. <br />4. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The Regulations applicable within the Trace Planned Development District <br />as approved by Ordinance No. 2015-42, and previous amendments thereto, are hereby amended as <br />shown in Exhibit A, attached hereto and made a part hereof. <br />SECTION 2. All other requirements for the Trace Planned Development District <br />approved by Ordinance No. 2015-42, as previously amended, shall remain in full force and effect. <br />SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is <br />held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of <br />this ordinance will continue in force if they can be given effect without the invalid portion. <br />SECTION 4. All ordinances and resolutions or parts of ordinances or resolutions in <br />conflict with this ordinance are repealed. <br />
