ORDINANCE NO. 2022-22 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AMENDING REGULATIONS AND STANDARDS APPLICABLE WITHIN THE TRACE PLANNED DEVELOPMENT DISTRICT CONSISTING OF APPROXIMATELY 417.63 ACRES OF LAND GENERALLY LOCATED AT 5818 SOUTH OLD BASTROP HIGHWAY, TO, AMONG OTHER THINGS, UPDATE PROVISIONS CONCERNING DOCUMENT ILLUSTRATIONS, THE ZONING CONCEPT PLAN, PUBLIC SPACE, CIRCULATION AND CONNECTIVITY, SITE DESIGN, ARCHITECTURAL DESIGN, SIGNAGE, AND APPENDIXES; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING AN EFFECTIVE DATE. RECITALS: 1. On February 8, 2022, the City Planning and Zoning Commission of the City of San Marcos held a public hearing concerning a request to amend certain regulations and standards applicable within the Trace Planned Development District consisting of approximately 417.63 acres of land generally located at 5818 South Old Bastrop Highway, as approved by Ordinance No. 2015-42, and previous amendments thereto. 2. Subsequent to the public hearing, the Planning and Zoning Commission considered the request and made a recommendation to the City Council. 3. The City Council held a public hearing on March 1, 2022, regarding the request. 4. The City Council hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Regulations applicable within the Trace Planned Development District as approved by Ordinance No. 2015-42, and previous amendments thereto, are hereby amended as shown in Exhibit A, attached hereto and made a part hereof. SECTION 2. All other requirements for the Trace Planned Development District approved by Ordinance No. 2015-42, as previously amended, shall remain in full force and effect. SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 4. All ordinances and resolutions or parts of ordinances or resolutions in conflict with this ordinance are repealed.
