<br />106. <br /> <br />RESOLUTION NO. 2002 - 23R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS CONCURRING IN THE <br />DECLARATION AS SURPLUS OF A PORTION OF THE <br />EXISTING RIGHT-OF-WAY AT THE INTERSECTION OF <br />STATE HIGHWAY 21 AND STATE HIGHWAY 80; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The Texas Department of Transportation ("TxDOT") holds title in a 0.424 acre <br />tract of land on (the "Property") along State Highway 21 at its intersection with State <br />Highway 80, more particularly described in the attached Exhibit A. <br /> <br />2. TxDOT has determined that the Property is no longer needed for the use of <br />citizens for roadway purposes, and has requested the concurrence of the City in this <br />determination. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. The City Council concurs with TxDOT that the Property is no longer <br />needed for the use of citizens for roadway purposes and the Property may be transferred <br />to the adjoining property owners for consideration provided to the State. <br /> <br />PART 2.
