56 RESOLUTION 199Ø - 10 R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS APPROVING THE TERMS AND CONDITIONS OF A PROPOSED AMENDMENT TO AND ASSIGNMENT OF THE LEASE OF AIRPORT PROPERTY BETWEEN THE CITY AND JOHN J. STOKES, SR. TO MCKEE AVIATION, INC.; AUTHORIZING THE CITY MANAGER TO EXECUTE LEASE AMENDMENT NUMBER TWO AND TO ACKNOWLEDGE THE CITY'S CONSENT TO SUCH ASSIGNMENT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City of San Marcos presently leases an area of property at the San Marcos Municipal Airport to John J. Stokes, Sr. by virtue of a lease agreement dated July 29, 1986, as amended by instruments dated August 25, 1986 and July 25, 1988; and WHEREAS, John J. Stokes, Sr. desires to assign his rights and obligations under this lease to McKee Aviation, Inc; and, WHEREAS, McKee Aviation, Inc. has requested amendment to Paragraph 5 of this lease to authorize the sale and servicing of aircraft instruments and avionics; and WHEREAS, the San Marcos Airport Commission has reviewed and given its approval to the proposed assignment of and amendment to this lease; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That the terms and conditions of the proposed assignment of the lease described above by John J. Stokes, Sr. to McKee Aviation, Inc. in substantially the form attached hereto as Attachment 1 are hereby approved. PART 2. That the terms and conditions of the proposed LEASE AMENDMENT NUMBER TWO, in substantially the form attached hereto as Attachment 2 are hereby approved. PART 3. That the City Manager, Larry D. Gilley be, and he is hereby authorized to execute the Agreement on behalf of the City. PART 4. That this Resolution shall be in full force and effect immediately from and after its passage.
