<br /> 119 <br />Regular Meeting March 26, 1984 Page 3 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE <br /> WHICH REGULATES AND RESTRICTS THE LOCATION AND USE <br /> OF BUILDINGS, STRUCTURES AND LAND, DATED SEPTEMBER <br /> 29, 1980 (VOL. 54) BYZONING 1.1 ACRES, MORE OR LESS, <br /> OUT OF THE J. M. VERAMENDI SURVEY NO. TWO BEING A <br /> PORTION OF THAT 2.29 ACRE TRACT OF LAND CONVEYED <br /> TO J. E. GARY AND CHRISTINE E. GARY BY DEED DATED <br /> AUGUST 26, 1960 AND RECORDED IN VOLUME 183, PAGE <br /> 289, HAYS COUNTY DEED RECORDS A/K/A 1629 OLD POST <br /> ROAD FROM "AO" (AGRICULTURAL-OPEN SPACE DISTRICT) <br /> TO "D" (MULTI-FAMILY DWELLING DISTRICT). <br />Mr. Guerra moved for approval of the Ordinance on first reading and <br />Ms. Kissler seconded the motion. City Manager Gonzalez asked Mr. <br />Hinnenkamp if the owners were aware the city needed to acquire a <br />10-foot right-of-way easement. Mr. Hinnenkamp replied that they <br />were aware of it. Mr. Brown asked if any reply had been received <br />from the state regarding the intersection at Old Post Road and <br />Loop 82. Daniel Brown said the City had received no reply and <br />Mr. Moore stated he would like to have a reply on this matter prior <br />to third reading of the Ordinance. The Council voted unanimous ap- <br />proval of the Ordinance on first reading. <br />Mr. Brown stated the Council would receive and review the bids and <br />consider approval to award sale of $5,800,000.00 City of San Marcos, <br />Texas Combination Tax and Revenue Certificates of Obligation, Series <br />1984-A. The City received bids from Merrill-Lynch Capital Markets <br />Group, Prudential-Bache Securities, Underwood-Neuhaus and Company, <br />and Mercantile Capital Markets. Messrs. Bill Harrison and Rick <br />Fisher needed to review the bids, so the Council moved to Item 9 <br />on the agenda. <br />Mr. Brown introduced for consideration adoption of an Ordinance on <br />emergency, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS AMENDING ORDINANCE 1983-45 ADOPTED <br /> SEPTEMBER 12, 1983 WHICH SET FORTH AN ITEMIZED ESTIM- <br /> ATE OF THE EXPENSE OF CONDUCTING EACH ADMINISTRATIVE <br /> UNIT OF THE MUNICIPAL GOVERNMENT OF SAID CITY FOR THE <br /> FISCAL YEAR BEGINNING OCTOBER 1, 1983, AND ENDING ON <br /> SEPTEMBER 30, 1984, AND APPROPRIATED MONEY FOR THE <br /> VARIOUS FUNDS AND PURPOSES OF SUCH ESTIMATE, TO REVISE <br /> SAID ESTIMATES AND TO REAPPROPRIATE SAID FUNDS; ADOPT- <br /> ING SAID REVISIONS AND ESTIMATES AND DECLARING AN EMER- <br /> GENCY. <br />Mr. Guerra moved for adoption of the Ordinance on emergency and Ms. <br />Kissler seconded the motion, which passed unanimQusly. <br />Mr. Brown introduced for consideration approval of an Ordinance on <br />first reading, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, AUTHORIZING THE TAX ASSESSOR-COLLECTOR <br /> OF THE CITY OF SAN MARCOS TO ADD AN ADDITIONAL CHARGE <br /> OF FIFTEEN PERCENT (15%) TO THE TAX BILLS OF DELINQUENT <br /> TAXPAYERS PURSUANT TO SECTION 33.07 OF THE TEXAS PROPERTY <br /> TAX CODE AND DECLARING AN EFFECTIVE DATE. <br />
