<br />Council concerning the proposed transfer <br />of development rights and the requested <br />density of the receiving zone, and any <br />proposed amendments to the San Marcos <br />Master Plan, if applicable. The Zoning <br />Commission shall make a recommendation <br />regarding the proposed zoning of any <br />granting or receiving zone, if applicable. <br /> <br />402.02. The Commissions may make additional <br />recommendations to the City Council which <br />are applicable to the proposed TDR. Such <br />recommendations may include conditions <br />which should be added to the zoning <br />ordinances which affect the transfer to <br />the receiving zone and creates the TDR-GZ <br />zoning district. <br /> <br />402.03. The Commissions shall consider the <br />Goals, Objectives and Policies of the San <br />Marcos Master Plan as the bases for making <br />its recommendation. <br /> <br />403. City Council. <br /> <br />403~cr1. The City Council of San Marcos shall <br />consider the proposed TDR based on <br />recommendations from the Planning and <br />Zoning Commissions. In order to affect <br />the TDR. the City Council shall: <br /> <br />403.01.01. Approve by resolution any <br />amendment to the San Marcos Master <br />Plan Future Land Use Plan applicable <br />to the TDR. <br /> <br />403.01.02. Pass an ordinance amending the <br />Official Zoning Map of the City of <br />San Marcos designating the granting <br />zone Transfer of Development Rights - <br />Granting Zone; TDR-GZ. <br /> <br />403.01.03. Pass an ordinance which <br />specifically states the maximum <br />allowable number of dwelling units in <br />the receiving zone, which would <br />reflect the allowable number of units <br />after the transfer is made. This <br />ordinance may be part of the <br />ordinance which rezones the receiving <br />zone. <br /> <br />403.02. The Council may include in these <br />ordinances any reasonable conditions which <br />are necessary to implement provisions of <br />the San Marcos Master Plan. <br /> <br />403.03. The City Council may not increase the <br />allowable number of units in the receiving <br />zone recommended by the Planning and <br />Zoning Commission except by a 3/4 vote of <br />the members of the City Council. If the <br />Planning and Zoning Commissions' <br />recommendations differ with respect to the <br />allowable density, the City Council may <br />approve the allowable density in the <br />receiving zone by simple majority of the <br />Council present at the time the ordinances <br />are considered. <br /> <br />5 <br />
