<br />4.2 <br /> <br />PAYMENTS ON ACCOUNT OF ADDITIONAL SERVICES <br /> <br />4.2.1 <br /> <br />Payments on account of the ARCHITECT's Additional Services as <br /> <br />defined in Paragraph 1.5 and for Reimbursable Expenses as defined in <br /> <br />Article 3 shall be made monthly upon presentation of the ARCHITECT's <br /> <br />statement of services rendered or expenses incurred, less any disputed <br /> <br />amounts, pending resolution thereof. <br /> <br />4.3 <br /> <br />PROJECT(S) SUSPENSION OR TERHDlATION <br /> <br />4.3.2 <br /> <br />If the Project(s) <br /> <br />is suspended or abandoned in whole or in <br /> <br />part for more than six (6) months, the ARCHITECT shall be compensated <br /> <br />for all services performed prior to receipt of written notice from the <br />OWNER of such suspension or abandonment. <br /> <br />ARTI CLB 5 <br /> <br />ARCHInCT . S ACCOUNTING RECORDS <br /> <br />5.1 <br /> <br />All <br /> <br />expense <br /> <br />records <br /> <br />of <br /> <br />ARCHITECT <br /> <br />shall <br /> <br />be <br /> <br />kept <br /> <br />on <br /> <br />a <br /> <br />recognized <br /> <br />accounting basis <br /> <br />acceptable <br /> <br />to <br /> <br />the OWNER <br /> <br />and <br /> <br />shall <br /> <br />be <br /> <br />available to the available to the OWNER or the OWNER's authorized <br /> <br />representative at mutually convenient times. <br /> <br />ARTICLE' 6 <br /> <br />OWNERSHIP AND USE OF DOCUMENTS <br /> <br />6.1 <br /> <br />Plans, <br /> <br />specifications, <br /> <br />and <br /> <br />other <br /> <br />. cons truct i on <br /> <br />contract <br /> <br />documents as well as all tracings, <br /> <br />survey notes and other original <br /> <br />documents shall become the property of the OWNER whether the Project(s) <br /> <br />for which they are made is executed or not. <br /> <br />However, ARCHITECT shall <br /> <br />not be responsible, and liability is hereby waived by OWNER against <br />ARCHITECT, and OWNER shall indemnify ARCHITECT from any and all losses, <br /> <br />claims, <br /> <br />demands <br /> <br />and <br /> <br />causes <br /> <br />of <br /> <br />action <br /> <br />resulting <br /> <br />from <br /> <br />OWNER's <br /> <br />intentionally, <br /> <br />willfully, <br /> <br />and wantonly <br /> <br />illegal <br /> <br />use <br /> <br />of <br /> <br />said plans, <br /> <br />specifications <br /> <br />and <br /> <br />construction <br /> <br />contract <br /> <br />documents <br /> <br />and/or <br /> <br />the <br /> <br />intentionally, willfully and wantonly illegal use by others if OWNER <br /> <br />has knowledge of such use by others, <br /> <br />and in such event, OWNER will <br /> <br />exercise its best efforts to notify ARCHITECT of such use by others. <br /> <br />6.2 <br /> <br />Submission <br /> <br />or <br /> <br />distribution <br /> <br />to <br /> <br />meet <br /> <br />official <br /> <br />regulatory <br /> <br />requirements or for other purposes in connection with the proj ect is <br />not to be construed as publication in derogation of the ARCHITECT's <br /> <br />rights. <br /> <br />-6- <br />
