<br />-19- <br /> <br />Metal Conduit, Electrical Metallic Tubing, or <br />Schedule 80 Rigid Nonmetallic Conduit. <br />Service-Entrance Cable (Article 338) will not be <br />authorized unless protected by approved condui t. <br />If the service entrance conduit is a service mast <br />then only two (2) inch or larger Rigid Metal <br />Conduit or Intermediate Metal Conduit shall be <br />used. <br /> <br />Sec. 9-8. <br /> <br />Exemptions. <br /> <br />(a) All electrical work under construction or <br />formally contracted for at the time of passage of <br />this chapter shall be exempted from the provisions <br />of this chapter. <br /> <br />(b) No permit is required to replace any <br />electrical fixtures or appliances which require no <br />change in the electric wiring. <br /> <br />Sec. 9-9. <br /> <br />Liability. <br /> <br />This chapter shall not be construed to relieve <br />from or lessen the responsibility of any <br />corporation, co-partnership, association, <br />individual, or agent installing, operating or <br />controlling any electric wiring or electrical <br />apparatus for damages to anyone or for full and <br />faithful performance of the contract, nor shall the <br />City of San Marcos, Texas, be held as assuming any <br />liability by reason of inspection, certificate, or <br />permit pursuant to the provisions of this chapter. <br /> <br />PART 2. Savinqs Clause: All sections, parts, words, <br />phrases, clauses, sentences or provisions of the existing <br />Electrical Code which are repealed by this amending ordinance <br />shall remain valid and enforceable with regard to any <br />violation of any section, part, word, phrase, clause, <br />sentence or provision hereby repealed, if such violation <br />occurred prior to the effective date of this amending <br />ordinance. <br /> <br />PART 3. Severability Clause: If any section, <br />subsection, sentence, clause, phrase or portion of this <br />ordinance is for any reason held invalid or unconstitutional <br />by any court of competent jurisdiction, such portion shall be <br />deemed a separate, distinct and independent provision and <br />such holding shall not affect the validity of the remaining <br />portions thereof. <br /> <br />PART 4. That this Ordinance shall be in effect ten <br />(10) days from and after its passage, and it shall be <br />published in a newspaper of general circulation in the area <br />as required by the Charter of the City of San Marcos, Texas. <br /> <br />PASSED AND APPROVED on first reading December 7, 1987. <br />PASSED AND APPROVED on second reading January 25, 1988. <br />PASSED, APPROVED February 8, 1988. <br /> <br />
