<br />-3- <br /> <br />what expenses are reimbursable and what <br />for reimbursement." <br /> <br />requirements <br /> <br />must be <br /> <br />met <br /> <br />JUSTIFICATION: <br /> <br />Confusion has arisen on several occasions in the past about the <br />propriety of certain expenses which have been claimed for <br />reimbursement by councilmembers. In addition, some councilmembers <br />who represent the City at State and national meetings and are <br />officers in municipal, state and national organizations have <br />expenses which may exceed the specific amounts provided in the <br />Charter. The Charter Review Commission believes that the normal <br />budgetary restraints that are placed on the City will control the <br />level of expense expenditures so that specific dollars amounts in <br />the City Charter are not necessary to protect the public interest. <br /> <br />6. <br /> <br />Sec. 3.06, Vacancies, should be revised as follows: <br /> <br />"A special election to fill a vacancy shall be called in <br />accordance with the Texas Election Code. ~-~~~~~~~~~ <br />Þ:e-14 -&G<*te- 1:'- - ~ -1::-& 1-1:'- ~y- - ~ ~ t- ~ - É- Feffi -1:-A-e- -4&'f" - i- ~ - i-e- -€-a- ~ ],.e.cl- . " <br /> <br />JUSTIFI CATION: <br /> <br />The second clause deleted above is surplus verbiage since the Texas <br />Election Code provides extensive regulations relating to calling <br />elections for vacancies, including the thirty (30) day requirement <br />in Section 3.06. <br /> <br />7. <br /> <br />Sec. 3.08, City Council not to interfere with appointments <br />removals, should be amended as indicated below: <br /> <br />or <br /> <br />"Neither the Council nor any of its members shall instruct or <br />request the City Manager or any of the City Manager's subordinates <br />to appoint to or remove from office or employment any person except <br />with respect to those offices which are to be filled by appointment <br />by the Council under the provisions of this Charter. Except ~ <br />t:tte-"'1"\:i"~-(7~-i-ftq-tri-.~-(7~-i:-~~i-g-a-~i-efi-, as provided for in Section <br />3.15 of this Charter, the Council and its members shall deal with <br />the administrative ~~~ and management functions of the City <br />solely through the City Manager and other Council appointees, <br />as appropriate, and shall not give orders to any of ~fte~~~ <br />their subordinates either publicly or privately." <br /> <br />JUSTIFICATION: <br /> <br />The Charter Review Commission is interested in clarifying the <br />functions of the various parties in a Council/Manager form of <br />government. It hopes that these few changes will reduce the <br />ambiguity in Section 3.08 and strengthen the relationships between <br />the City Council and all of its appointees. <br />
