<br />-2- <br /> <br />Council on any board, commission, committee, organization or entity <br />Tn the Council's sole discretion so long as that person's service <br />does not extend beyond his or her Council term." <br /> <br />JUSTIFICATION: <br /> <br />Some ordinances require that a member of the City Council shall <br />be appointed to various boards and committees to represent the <br />Council. without clarification, this section could be construed <br />to prohibit that practice. <br /> <br />4. <br /> <br />Sec. 3.02(a)(5) which provides that a council member shall not be <br />an officer, director or owner of a public service corporation <br />serving the inhabitants of the City, should be amended to change <br />the phrase "public service corporation" to "public service company" <br />and to define "public service company" as follows (changes <br />are underlined): <br /> <br />"Shall not be an officer or director of any public service <br />company wi thin the Ci ty or, wi thout the Ci ty but serving <br />inhabitants of the City, nor be the owner or proprietor of any <br />public service company in the City. Public service company should <br />be defined as any company, individual, partnership, corporation or <br />other entity recognizeg,by law that, in the course of its principal <br />business, uses any of~'the City's streets, alleys, highways o~ <br />grounds of the City to carry out its primary purpose, which purpose <br />may include but not be limited to transportation, sale, or use 2I <br />water, gas, electricity, conduit, telegraph, telephone, commercial <br />railway or street railway." <br /> <br />JUSTIFICATION: <br /> <br />As presently written, the phrase "public service corporatiort" is <br />vague and subject to more dispute about its meaning than would be <br />the case by changing the name to "public service company" and <br />carefully defining it. <br /> <br />5. <br /> <br />Sec. 3.04, Compensation, should be amended as follows, with <br />deletions shown by striking through the word and additions shown by <br />underlining. <br /> <br />"Members of the City Council shall serve without payor <br />compensation; provided, however, that they shall be entitled to all <br />necessary expenses incurred in the performance of their official <br />duties. ~§4RR4R§-w4~~-~~e-aRR~a~-~4~~-Ð~è§e~-~e~-~Ðe--~4£€a~--yea~ <br />1~23=24, There shall be provided in each annual City budget an <br />amount ~-~e-e*€eeè--~4*--~Ðe~Saflè--Ðe~~a~s--~~~,~~~õ~~~ for the <br />expenses of the Mayor and ~Ð~ee--~~~saflè--£4*-Htlflè~eè-Ðe~~a~s- <br />~$~,6~~õ~~~-~e~-~fte-e*~eflses of each Councilmember e*~~~~~flg-M~yor. <br />The Mayor and the members of the City Council shall be reimbursed <br />for the amounts so provided for in the annual City budget for <br />their actual official City business expenses.
