<br /> 63 <br /> Regular Meeting August 13, 1984 Page 5 <br /> ANYONE OTHER THAN THEMSELVES IN MUNICIPAL COURT <br /> PROCEEDINGS INSTITUTED BY CITY OFFICERS AND EM- <br /> PLOYEES IN THE COURSE OF OFFICIAL DUTIES; AMENDING <br /> SECTION 2-73 OF SAID DIVISION OF SAID ARTICLE OF <br /> SAID CHAPTER OF SAID CODE TO ADD SUBSECTION (e) <br /> TO PROVIDE THAT NO CITY OFFICER OR EMPLOYEE SHALL <br /> BE DEPRIVED OF DUE PROCESS RIGHTS; AMENDING SECTION <br /> 2-81 OF DIVISION 2 OF SAID ARTICLE OF SAID CHAPTER <br /> OF SAID CODE TO AMEND THE DEFINITION OF "CITY OFFI- <br /> CIAL"; AND DECLARING AN EFFECTIVE DATE. <br /> Mayor Craddock moved for approval of the Ordinance on first reading <br /> and Ms. Kissler seconded the motion. City Attorney Hankins stated <br /> this matter had been before the Ethics Commission for nine months. <br /> Jim Nias of Small, Craig and Werkenthin offered another Ordinance <br /> for the Council's consideration. Mayor Craddock said it was not <br /> on the agenda for discussion and was out of order and directed Mr. <br /> Nias contact the City Secretary to be scheduled on a future agenda. <br /> The Council then voted unanimous approval of the Ordinance on first <br /> reading. <br /> Mayor Craddock then announced Item 14A would be discussed at this <br /> point on the agenda, a discussion of a 150-room hotel with restaur- <br /> ant/bar and banquet/meeting room to be constructed at old Hays <br /> Memorial Hospital site and Hays County Commissioners' Court request <br /> for LUEs. Judge Walter Burnett stated the Commissioners' approval <br /> of the project and asked for the Council's favorable consideration <br /> of the project. Judge Burnett introduced R. C. Shades, Larry Bloomer <br /> and Larry Freeman. Mr. Shades (of Oklahoma City) stated the proposed <br /> Sheraton for San Marcos would be 8 stories, have a banquet room which <br /> would seat 300 to 350 perons, have a multi-level lobby and would make <br /> a significant economic impact on San Marcos. Mr. Coddington asked <br /> questions relating to whether or not the City would have a taxable <br /> base on the Sheraton project. Judge Burnett stated Mr. Spain of <br /> Fulbright and Jaworski, the County's bond consultant, was present <br /> to answer any questions the Council may have. Ms. Kissler asked the <br /> City Manager how many LUEs would be needed for this project, and he <br /> stated approximately 77 Sewer LUEs and 50 Water LUEs. <br /> Mayor Craddock introduced for consideration adoption of an Ordinance <br /> on third and final reading, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCO S, TEXAS, AMENDING SECTIONS 30-45 (b) (3) AND <br /> (b) (5) OF DIVISION 4. SEWAGE SYSTEM CAPITAL RECOVERY <br /> FEE, OF ARTICLE II. SERVICE CHARGES, OF CHAPTER 30 <br /> OF THE CODE OF ORDINANCES OF SAID CITY TO CHANGE THE <br /> SCHEDULE FOR DETERMINING LUE'S FOR HOTEL/MOTELS WITH <br /> RESTAURANT AND/OR BAR AND FOR RESTAURANT/BAR; AMEND- <br /> ING SECTION 30-49 OF SAID DIVISION OF SAID ARTICLE <br /> OF SAID CHAPTER OF SAID CODE TO ALLOW APPLICANTS FOR <br /> SEWERAGE CAPACITY FOR USES OTHER THAN SINGLE-FAMILY <br /> UNITS TO USE THEIR RESERVATIONS FOR CAPACITY REMAINING <br /> IN THE EXISTING FACILITY UNDER CERTAIN CONDITIONS, CLARI- <br /> FYING THE PURPOSE FOR RESERVATIONS, AND PROVIDING THAT <br /> RESERVATIONS MAY BE USED TO SATISFY THE REQUIREMENT FOR <br /> THE ISSUANCE OF BUILDING PERMITS TO DEVELOPMENT PROJECTS <br /> BASED ON CERTIFICATION OF AVAILABLE CAPACITY; AND DECLAR- <br /> ING AN EFFECTIVE DATE. <br /> Mayor Craddock moved for adoption of the Ordinance and Mr. Farr second- <br /> ed the motion, which passed unanimously. <br />
