<br />Hemorandum of Understanding <br /> <br />-3- <br /> <br />supervisor of the responding agency, except in cases where an <br /> <br />emergency precludes obtaining approval from either or both. <br /> <br />5. <br /> <br />Liaison for Criminal Investigations <br /> <br />5.01. <br /> <br />SWT's Police Department will investigate criminal <br /> <br />offenses occurring on property owned, leased or controlled by the <br /> <br />university. <br /> <br />The City's Police Department will investigate <br /> <br />criminal offenses occurring within the city but generally not on <br /> <br />property owned, leased or controlled by the university. <br /> <br />While on <br /> <br />duty university peace officers may take action on offenses <br /> <br />occurring in their presence on city streets. <br /> <br />While on duty SMPD <br /> <br />officers may taken action on offenses occurring in their presence <br /> <br />on property owned leased, or controlled by the university. <br /> <br />5.02. <br /> <br />San Marcos Police Deaprtment officers shall seek and <br /> <br />SWT's Police Department shall offer assistance to the city peace <br /> <br />officers when they execute an arrest warrant or search warrant on <br /> <br />the university campus. <br /> <br />The S\IT Police Department officers <br /> <br />assisting the City's officers executing the warrant vdll determine <br /> <br />in advance the location of the suspect, his class schedule, his <br /> <br />residence hall, or place of employment in order to minimize <br /> <br />disruption of classes, reduce the chances for error, increase the <br /> <br />chances of successful arrest, and reduce the chance of confronta- <br /> <br />tion. <br /> <br />5.03. <br /> <br />When a university police officer is executing an <br /> <br />arrest warrant or a search warrant off campus, he or she shall <br /> <br />seek the cooperation of the City Police Department. <br />
