160 AGREEMENT FOR SHORT-TERM IEASE OF PUBLIC rANDs The City of San Marcos (Lessor) hereby agrees to lease parklanrl bounded by Hopkins Street, the M-K-T Railroad tracks, and the U.S. Army Reserves building to the San Marcos Chamber of Commerce (Lessee), for the purpose of allowing Lessee to conduct a carnival from February 17, 1988 through February 28, 1988, at said location, in consideration för the f 011 ow i ng : 1. Lessee hereby agrees to procure and maintain, or cause to be procured and maintained, insurance coverage for bodily injury and property damage which may arise from the activities which are the subject of this lease. Such insurance shall be with an insurance company authorized to do business in the State of Texas. Such insurance shall cover all operations under this lease, whether conducted by Lessee, its agents or subcontractors and said coverages shall have minimum limits of liability of not less than 1 million dollars (51,000,000.00). All coverages shall be maintained for at least a period of six (6) months from the execution of this lease. Until such coverage. is in effect, Lessee, its agents and subcontractors shall not make any use of said demised premises. 2. Lessee hereby agrees to pay to Lessor, in advance of commencement of activities, two Hundred Dollars (5200.00) in deposit and One Hundred Dollars ($100.00) as a use fee for the use of said location. 3. Lessee hereby assumes the risk of, and agrees to indemnify and hold harmless against all liability, damages, expenses, attorney's fees, and costs for injuries to and deaths of persons whomsoever, including employees of the Lessee and Lessor, and damages to and destruction of property whosesoever, including property of Lessee and Lessor, growing out of, incident to, or in any manner resulting directly or indirectly out of this Agreement unless caused solely and directly by the negligence of Lessor, its agents or employees. In addition, Lessee shall reimburse Lessor for any damages or repairs to Lessor's property resulting in any manner whatsoever from this Agreement. By signing below and returning to the City of San Marcos you shall affirm your assent and agreement to the terms and provisions contained herein and you bind yourself.to the same.
