<br />11 <br /> <br />THE STATE OF TEXAS <br /> <br />COUNTY OF CALDWELL <br /> <br />KNOW ALL MEN BY THESE PRESENTS: <br /> <br />This <br /> <br />agreement <br /> <br />pertains <br /> <br />to <br /> <br />the <br /> <br />agricultural <br /> <br />use <br /> <br />of <br /> <br />certain lands, herein described, located at the San Marcos <br /> <br />Municipal Airport, situated in Caldwell County, Texas. <br /> <br />The <br /> <br />agreement is made and entered into by and between the City of <br /> <br />San Marcos, Hays and Caldwell Counties, Texas, herein called <br /> <br />"Lessor" and Mr. Harrell Tietjen, herein called "Lessee". <br /> <br />I. <br /> <br />DESCRIPTION OF DEMISED PROPERTY <br /> <br />The <br /> <br />demised <br /> <br />property <br /> <br />consists <br /> <br />of <br /> <br />one <br /> <br />( 1) <br /> <br />tract <br /> <br />as <br /> <br />described <br /> <br />below <br /> <br />and <br /> <br />identified <br /> <br />on <br /> <br />the <br /> <br />accompanying <br /> <br />map <br /> <br />attached as Exhibit A and incorporated herein and made part <br />hereof for all purposes. <br /> <br />Tract A. <br /> <br />Tract A consists of that area outlined in <br /> <br />green on Exhibi t A which is <br /> <br />immediately adjacent to the <br /> <br />runways and taxiways at the airport. <br /> <br />It includes all of the <br /> <br />land bounded on the sides by the concrete apron and segments <br />of runways 8-26 and 12-30 closest thereto, and on the ends by <br /> <br />taxiways A and F. <br /> <br />II. <br /> <br />DEMISED PROPERTY RESTRICTIONS <br /> <br />The site of all leased property is within the boundaries <br /> <br />of the San Marcos Municipal Airport. <br /> <br />The airport is an <br /> <br />active, municipally sponsored, <br /> <br />and federally funded public <br /> <br />use airport. <br /> <br />The FIRST and FOREMOST role of the airport, <br /> <br />including <br /> <br />all <br /> <br />lands <br /> <br />and <br /> <br />facilities, <br /> <br />is <br /> <br />as <br /> <br />an <br /> <br />airport. <br /> <br />Agricul tural activities at the airport are authorized on a <br />non-interference basis with the primary aviation role of the <br /> <br />airport. <br /> <br />Therefore, <br /> <br />the <br /> <br />following <br /> <br />restrictions <br /> <br />to <br /> <br />agricultural activity apply: <br />
