15 LEASE AGREEMENT STATE OF TEXAS COUNTY OF HAYS This Agreement is for the lease and use of certain property, herein described, located at the San Marcos Municipal Airport, situated in Caldwell County, Texas, for specific dates. This agreement is made and entered into by and between the City of San Marcos, Hays and Caldwell Counties, Texas, herein referred to as "Lessor" and the Alamo Region Sports Car Club of America, Inc., herein referred to as "Lessee." 1. Leased Premises The leased premises consists of certain portions of the San Marcos Municipal Airport, (Airport) commonly known as the Southeast parking apron and more particularly identified by the shading on the attached airport photographic layout attached hereto as Exhibit "A" and made a part hereof for all purposes. 2. Purposes The leased premises shall be used to hold motor sports events in general, which shall include, but not necessarily be limited to, road racing and competitive events involving motor vehicles. 3. Term This agreement shall commence upon the execution of this lease by Lessor and Lessee and continue for a term of one (1) year subject, however, to the other terms and conditions set out herein. 4. Events and Use Dates (A) The proposed events and dates of usage during the term of the lease are as follows: (a) (b) Drivers School - May 14 & 15, 1988. Closed National - July 16 & 17, 1988 (B) Said dates are tentative and may be changed and amended from time to time by the written agreement of both Lessor and Lessee. Any agreement to so change or amend a use date shall be made within thirty (3Ø) days of the use date to be changed or amended. 5. Hours of Operation The leased premises may be used from 12:Ø1 a.m. on the beginning date of use until 11:59 p.m. on the last day of use for each event. 6. Consideration The fee for use of the leased premises is One ThOUSauù. Dollars ($lØØØ.ØØ) per day of use, payable to the City of San Marcos. It is agreed that the total fee for the term of this lease shall be no less than four Thousand Dollars ($4,ØØØ.ØØ), provided however, that use dates may be changed or amended as set forth in paragraph 4, and that fees from an event which has been cancelled or rescheduled for any reason by Lessee may be applied to a new or alternate date so long as that date is within the term of the lease as set forth in paragraph 3.
