<br />-2- <br /> <br />Such sums for each event shall be paid by Lessee and <br />sent or delivered to Lessor's Finance Department, c/o <br />"Accounts Receivable" at 63Ø East Hopkins, San Marcos, Texas <br />78666 on or before seven (7) days prior to the first day of <br />each event as set forth in paragraph 4(a) or as <br />subsequently agreed upon by Lessor and Lessee pursuant to <br />paragraph 4(b). <br /> <br />7. <br /> <br />Suitability of Premises <br /> <br />Lessee agrees that it has inspected the premises <br />described in Exhibit A and accepts them as being fit and <br />suitable for the uses and purposes described herein. <br /> <br />8. <br /> <br />Access <br /> <br />Included in this lease shall be the right of reasonable <br />access as needed over other airport properties in order to <br />reach the leased premises from adjacent public roads. <br />However, access by aviation pavements including taxiways, <br />runways, and aircraft parking areas, is subject to prior <br />notification of the Airport Manager who will determine access <br />routing and control, so as to preclude interference with <br />airport aviation activity. <br /> <br />9. <br /> <br />Return of Premises <br /> <br />Lessee agrees to keep and protect the leased premises in <br />a neat and orderly manner and to repair all damages to real <br />or personal property of Lessor on the leased premises which <br />are caused by Lessee, its employees, patrons, contractors or <br />invitees, or otherwise arising out of Lessee's use or <br />occupancy of the premises. Lessee further agrees to <br />surrender the leased premises to Lessor in as good a <br />condition as when received, normal wear and tear accepted, at <br />the termination of each event. <br /> <br />IØ. <br /> <br />Preparation and Clean-up <br /> <br />Access to the leased premises shall be made available to <br />Lessee at least one (I) day ahead of each beginning day in <br />order that the property may be prepared for use by Lessee. <br />Such access in advance of lease dates will be on a strictly <br />non-interference basis with normal airport activity. <br />Lessee shall see to it that the aviation pavrnents are <br />available for unrestricted airport use at the end of the last <br />day of use and shall have one ( 1) day to clean-up the <br />remainder of the property to such conditions as accepted by <br />Lessee at the start of the event. <br /> <br />11. <br /> <br />Compliance With Governmental Agencies <br /> <br />Lessee agrees that its agents, officers, employees, <br />invitees, and licensees will comply with all applicable <br />federal, state and municipal laws, statutes, charters and <br />ordinances and comply with all regulations and directions of <br />Lessor applicable to the airport generally. <br />This agreement is subject to the prior approval of the <br />Federal Aviation Administration (FAA), and the rights of the <br />United States of America to have exclusive or non-exclusive <br />use, control and possession, without charge, of the Airport <br />or any portion thereof during periods of National Emergency; <br />and, it is further subject to the right of the FAA and the <br />United States Government to take a portion of the Airport <br />premises for activities related to air traffic control. <br /> <br />12. <br /> <br />Interference with other Operations and Activities <br /> <br />Lessee agrees that it will use the leased premises and <br />any other airport property in a manner which will not <br />interfere with the normal activities and operations of the <br />airport and its tenants. <br />
