<br />-3- <br /> <br />13. <br /> <br />Insurance <br /> <br />Lessee shall, at its own expense, purchase, maintain and <br />keep in force such insurance as will protect it from claims <br />set forth below which may arise out of or result from its <br />operations under this agreement. <br /> <br />13.1 At all times during the term of this lease, except <br />as provided in paragraph Section 13.2, below, Lessee shall <br />purchase, maintain and keep in force: <br /> <br />(a) Such insurance as will protect Lessee from claims <br />from damages because of bodily injury, personal injury, <br />sickness, disease or death with minimum limits of liability <br />of not less than $5ØØ,ØØØ.øø each occurrence and $5ØØ,ØØØ.øØ <br />aggregate. <br />(b) Such insurance as will protect Lessee from claims <br />for damages for injury or destruction of tangible property of <br />others, including loss of use thereof with minimum limits of <br />liability not less than $5ØØ,ØØØ.ØØ each occurrence and <br />$SØØ,øøø.øø aggregate. <br />(c) A Certificate of Insurance for coverage required in <br />this Section 13.1 shall be filed with the Lessor within 14 <br />days of the execution of this lease by Lessee and Lessor and <br />is subject to Lessor's approval. <br /> <br />13.2 At all times during the dates of usage as set forth in <br />Paragraphs 4 and 5 of this lease, or any amendment thereto, <br />Lessee shall purchase, maintain and keep in force: <br /> <br />(a) Such insurance as will protect Lessee from elaims <br />from damages because of bodily injury, personal injury, <br />sickness, disease or death with minimum limits of liability <br />of not less than $1, øøø, øøø . øø each occurrence and <br />$l,ØØØ,Øøø.øø aggregate. <br />(b) Such insurance as will protect Lessee from claims <br />for damages for injury or destruction of tangible property of <br />others, including loss of use thereof with minimum limits of <br />liability not less than $l,ØØØ,Øøø.øø each occurrence and <br />$l,ØØØ,Øøø.øø aggregate. <br />(c) A Certificate of Insurance for coverage required in <br />this Section 13.2 shall be filed with Lessor at least 14 days <br />prior to each date of usage as set forth in Paragraphs 4 & 5 <br />of this lease. <br /> <br />13.3 Such insurance as is required under this paragraph 13 <br />shall be written so that Lessor will be notified in writing, <br />by registered mail, in the event of cancellation, restrictive <br />amendment or non-renewal at least thirty (3Ø) days prior to <br />such action. <br />All insurance required under this paragraph 13 shall be <br />written with the City of San Marcos, Texas, as an additional <br />insured. <br />Any insurance policy herein required or procured by <br />Lessee shall contain an express waiver of any rights of <br />subrogation by the insurance company against Lessor. <br />The stated limits of insurance required by this <br />paragraph 13 are MINIMUM ONLY and it shall be Lessee 's <br />responsibili ty to determine what limits are adequate. These <br />minimum limits may be basic policy 1imi::..:; OL" any .:::am!:::::::"':::'.. -:---. <br />of basic limits and umbrella limits. In any event, Lessee is <br />fully responsible for all losses arising out of, resulting <br />from or connected with operations under this agreement <br />whether or not said losses are coverable by insurance. <br />Lessors acceptance of a Certificate of Insurance that in any <br />respect does not comply with the requirements of this <br />agreement does not release Lessee from compliance herewith. <br />
