Since the Council denied amendment of the
Moratorium Ordinance to delete the word "detached" from Section 1,
Mayor Craddock moved to deny approval of this request and Mr. Brown
seconded the motion, which passed unanimously.

Mayor Craddock introduced for consideration approval of a request for
processing of permit from S. E. Rutledge on the Maple Creek Condominiums.
Earlier in the meeting the Council approved amendment to the Moratorium
Ordinance to delete Section 6 of the Ordinance. Therefore, the Council
could consider approval of this request. Mr. Farr moved for approval
that the revoked permit be reinstated and a restriction be imposed in
the permit that only twelve condomiums can be permitted to be constructed
during the moratorium period and a portion of the prior permit be rebated
wherein the original permit allowed for the construction of twenty-four
condominiums. Mr. Guerra seconded the motion. On roll call the follow-
ing vote was recorded:

AYE: Brown, Farr, Craddock, Guerra, Kissler.

NAY: Coddington.

ABSTAIN: None.

Mayor Craddock introduced for consideration approval of a request for
processing of permit from Nash Phillips/Copus (NPC) on The Summit pro-
ject. NPC had requested a permit prior to the moratorium being adopted
by the Council and were denied permit because the Staff knew the Council
was going to consider imposing the moratorium. Dan Davidson of NPC said
they would offer a contribution towards a special fund for a package sewer
treatment plant to assist the City in obtaining more sewage capacity until
our sewer treatment plant is cDnstructed, thus making available additional
LUEs. Mayor Craddock moved to approve the processing of their permit and
Mr. Guerra seconded the motion. On roll call the following vote was re-
corded:

AYE: Brown, Farr, Craddock, Guerra, Kissler.

NAY: Coddington.

ABSTAIN: None.

Mayor Craddock introduced for consideration approval of a request for
processing of permit from S. E. Rutledge on duplex construction in
the Westover Addition. Ms. Kissler moved the matter be tabled from
consideration until after the moratorium and Mr. Guerra seconded the
motion, which passed unanimously.

Mayor Craddock introduced for consideration approval of an Annexation
Ordinance on first reading, the caption which was read as follows:

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
MARCOS, TEXAS, ANNEXING TO SAID CITY A TRACT OF LAND
CONTAINING 203.05 ACRES OF LAND, MORE OR LESS, IN THE
CYRUS WICKSON SURVEY AND THE BARNETT O. KANE SURVEY,
IN HAYS COUNTY, TEXAS, SAID LAND BEING LOCATED WITHIN
THE EXTRATERRITORIAL JURISDICTION OF SAID CITY AND LY-
ING ADJACENT TO PRESENT CITY BOUNDARIES; APPROVING A
SERVICE PLAN FOR SAID TRACT; EXTENDING THE BOUNDARY
LIMITS OF SAID CITY SO AS TO INCLUDE SAID TRACT; GRANT-
ING TO THE INHABITANTS OF SAID TRACT ALL THE RIGHTS
AND PRIVILEGES OF OTHER CITIZENS OF SAID CITY; BINDING
SAID INHABITANTS BY ALL OF THE ACTS AND ORDINANCES, RULES
AND REGULATIONS OF SAID CITY AND DECLARING AN EFFECTIVE
DATE.
