4. Reconvene and Consider Action on Item Discussed Durine Executive Session. • <br />The San Marcos City Council reconvened into regular session at 6:58 p.m. on Tuesday, February <br />17, 2009. No action was required from Executive Session. <br />5. Invocation <br />Pastor Tim Darnell, of the Hill Country Church, provided the invocation. <br />6. Pledge of Allegiance <br />Councilmember Thomaides led the assembly in the Pledge of Allegiance. <br />7. Citizen Comments <br />Camille Phillips, a San Marcos resident, expressed her concern about the proposed apartments at <br />Hunter & Wonder World. This is a prime commercial location and should have commercial <br />development there because it is located at the intersection of two major arterials. Also, it is close <br />to the flood plain and will flood. The traffic will stress the neighborhood. She reported that the <br />Mayor was quoted as saying that San Marcos does not look good on paper, but Ms. Phillips <br />noted that San Marcos doesn't look good if a person drives around either. She stated that our <br />development standards are low and commented that Kyle is so pretty because of their high <br />standards. • <br />Betsy Robertson, 1410 Progress, said she was here to speak for the chickens. She reported that <br />Council passed an ordinance that increases the distance from livestock from 30' to 100'. She <br />requested that language be inserted to exclude hens. People depend on eggs for protein and also <br />for a little bit of income. They are also required to be housed and contained. There is oversight <br />for the cleanliness of the flock. She asked Council to consider this as they look at the Animal <br />Ordinance. <br />Dan McCarthy, 905 Hillyer, spoke on item #21 and stated he is opposed to the Graffiti <br />Ordinance. He believes this is another unenforceable, personal responsibility ordinance. He <br />expressed concern this will be selectively enforced, and result in the penalty of a thought crime. <br />He noted that if there is no graffiti then there is no crime. San Marcos is beginning to look like a <br />police state. This is worrisome to students that may want to have a life here. This issue also <br />came up last fall when the City purchased a soda blaster. This just resulted in giving graffiti <br />artists another blank canvass. He recommended a public art space. <br />Dianne Wassenich, 11 Tanglewood, brought back a chart showing how increased impervious <br />cover increases storm flows. There are areas in San Marcos that are dangerous places because of <br />the way our two rivers intersect and back up at times. There is an increased danger if we <br />continue to develop on the recharge zone. There is already some development on the recharge <br />zone that is increasing storm flows, and they are becoming more rapid and dangerous. <br />Development on the recharge zone and building wastewater lines over the recharge zone is <br />• <br />RM021709 Minutes Page 2
