Larry Gill, Austin, Texas, developer of project, stated the project has 293 units. He was attracted • <br />to this piece of land because of Purgatory Creek. They are constructing two and three story <br />buildings. On Hunter they are doing two-story buildings with tile roofs. All the trees on Hunter <br />will be there when the project is completed. He reported that he has done five condominium <br />projects in Austin and is experienced with conversions. The density is 14 units per acre for a low <br />density. The lake in middle of the project will be an amenity. The project is two blocks from the <br />new government center for the county courts and that is the target market. He respects the <br />neighborhood's concerns, but the creek is between the project and the neighborhood, and they <br />won't even know we are there. He asserted that he wants to be an asset to the city. <br />Ed Theriot, Lockhart, Texas, architect for the project, stated the project has been developed as a <br />Class-A non-student community. Safeguards have been put into place to safeguard that the <br />residents reflect that goal. The density is just below 14 - it is right at 12 for a medium density. <br />The rent levels will be high, and they will lease by the unit, not by the bedroom. They are <br />incorporating occupancy restrictions implemented by the City for a residential district. Property <br />rules will be strictly enforced. They are requesting a parking modification of 1.9 spaces per unit. <br />This will be justified by the fact they will be providing residential garages that will be used as <br />parking facilities only. The lease agreement will limit the number of cars to two per lease. <br />Mark Wheeler, Austin, Texas, stated that he takes environmental impacts very seriously. He <br />stated they are down zoning the property from commercial to apartment/multi-family. They are <br />reducing the traffic impact for the intersections. Surrounding properties are zoned industrial, and • <br />it would require an up zone to change the zoning to apartments. The property was originally <br />purchased as a site for a grocery store, but later realized it would not fit on the site. Also, major <br />retailers want to be on the freeway. There is no demand for this property as commercial. He <br />referenced a study that indicates a shortage of high end apartments for this area. <br />There being no further comment, the Public Hearing was closed at 8:24 p.m. <br />MOTION: Upon a motion made by Councilmember Terry and a second by Councilmember <br />Thomaides, the City Council voted two (2) for and four (4) opposed, with Councilmembers <br />Bose, Jones, Terry and Thomaides voting against, to approve Zoning Ordinance 2009-12, as <br />previously captioned. The motion failed. <br />20. Remove from table to discuss graffiti abatement and consider an ordinance amending <br />Chapter 54, Miscellaneous Offenses, of the San Marcos City Code by adding Article 4, <br />Possession of Graffiti Implements; defining and establishing restrictions on the possession <br />of graffiti implements; establishing penalties for the violation thereof, providing a savings <br />clause; providing for the repeal of any conflicting provisions; providing for publication; <br />and providing an effective date; and consider ordinance on first of two readings. <br />MOTION: Upon a motion made by Mayor Narvaiz and a second by Councilmember Bose, the <br />City Council voted six (6) for and none (0) opposed, to table this item for further review.
