No one else <br />wished to speak in favor or in opposition, so Mayor Craddock closed <br />the public hearing. The Council then considered an Ordinance on <br />first reading, the caption which was read as follows: <br /> <br />APPENDIX A - GENERAL ZONING ORDINANCE <br /> <br />AN ORDINANCE TO REGULATE AND RESTRICT THE LOCATION <br />AND USE OF BUILDINGS, STRUCTURES AND LAND; DECLAR- <br />ING THE PURPOSE; PROVIDING FOR CHANGES AND AMENDMENTS; <br />ESTABLISHING AN OFFICIAL ZONING MAP; ESTABLISHING DE- <br />FINITIONS; DESIGNATING DISTRICTS; PROHIBITING. USE; <br />PROVIDING FOR NEWLY ESTABLISHED TERRITORY; SETTING <br />FORTH USE RESTRICTIONS IN THE SEVERAL DISTRICTS; <br />ESTABLISHING LAND COVERAGE; PROVIDING FOR PARKING; <br />PROVIDING FOR SETBACK; DEFINING NONCONFORMING USES; <br />PROVIDING FOR A BOARD OF ADJUSTMENT; PROVIDING EN- <br />FORCEMENTS AND REMEDIES; CLARIFYING CONFLICTING OR- <br />DINANCES; PROVIDING FOR A SAVINGS CLAUSE; AND ESTABLISH- <br />ING AN EFFECTIVE DATE. <br /> <br />Mr. Coddington moved for approval of the Ordinance on first reading <br />and Mr. Brown seconded the motion. Mr. Coddington pointed out several <br />typographical errors throughout the Ordinance, which were noted. Mr. <br />Coddington moved to amend Section Dl.Area Requirements, on Page <br />1086.6 to add "No M-FS development shall exceed a density of more <br />than forty (40) dwelling units per gross acre," and Mr. Farr second- <br />ed the motion, which passed unanimously. Mr. Farr moved to amend <br />Section C. Prohibited Uses to add "2. Any use of a single-family <br />dwelling unit by more than two individuals who are unrelated by <br />blood, legal adoption, or marriage. The owner and any agent of <br />the owner shall be legally responsible for any dwelling unit use," <br />on Pages 1084, 1084.1 and 1084.2. Ms. Kissler seconded the motion, <br />which passed unanimously. Shirley Wickersham suggested the Council <br />consider amending on Page 1084.1, Section D. Area Requirements. 7. <br />the maximum building coverage as a percentage of lot area from "60%" <br />to "80%". The Staff was directed to review the Landscape Ordinance <br />and make a reconunendation to the Council on her request. City Man- <br />ager Gonzalez stated properties, such as "Mixed" in the current <br />Ordinance would not be changed until such time as they are developed. <br />Mr. Hankins stated there were no substantial changes except 28 units <br />being changed to 24. The present "D" zoning will be "MF-4" in the <br />new Ordinance. The Council voted unanimous approval of the Ordinance <br />on first reading. <br /> <br />Mayor Craddock introduced for consideration adoption of an Ordinance <br />on emergency, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING ORDINANCE 1983-4S, ADOPTED <br />SEPTEMBER 12, 1983, WHICH SET FORTH AN ITEMIZED ESTIM- <br />ATE OF THE EXPENSE OF CONDUCTING EACH ADMINISTRATIVE <br />UNIT OF THE MUNICIPAL GOVERNMENT OF SAID CITY FOR THE <br />FISCAL YEAR BEGINNING OCTOBER 1, 1983, AND ENDING ON <br />SEPTEMBER 30, 1984, AND APPROPRIATED MONEY FOR THE VAR- <br />IOUS FUNDS AND PURPOSES OF SUCH ESTIMATE; TO REVISE <br />SAID ESTIMATES AND TO REAPPROPRIATE SAID FUNDS; ADOPT- <br />ING SAID REVISIONS AND ESTIMATES AND DECLARING AN EMER- <br />GENCY. <br />
