<br />49 <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />Regular Meeting June 11, 1984 Page 6 <br /> <br /> <br />Mayor Craddock introduced for consideration approval for authoriza- <br />tion of $1,000.00 from contingency funds for the City of San Marcos' <br />participation in Operation Water Conservation (as adopted by the <br />Council earlier in this meeting). Mayor Craddock moved for authoriza- <br />tion and Mr. Farr seconded the motion, which passed unanimously. <br /> <br />Mayor Craddock introduced for consideration direction to Staff to pro- <br />ceed with the development of the willow Creek Interceptor (sewer main). <br />Eugene Chavez of Bluebonnet Development Corporation said they would pay <br />for the engineering ($8,000) and would pay whatever the charge is which <br />has not yet been determined by the Council (suggested to be $350) for <br />the interim package plant LUE charge plus the $900 per LUE capital re- <br />covery fee for 80 LUEs, and that they would only need 30 LUEs during <br />the next 2 years. The Council directed Mr. Gonzalez to proceed with <br />discussions with the developer to construct the interceptor. The bid <br />will come before the Council for approval of the 12" main in the form <br />of Resolution at a future time. <br /> <br />Mayor Craddock introduced a report from the City Manager regarding the <br />status of the package treatment plant. After discussion the Council <br />accepted the City Manager's recommendations (attached to these minutes), <br />directed a Moratorium Ordinance be prepared and presented on emergency <br />at the June 13, 1984 Council Meeting, directed public hearing notice <br />be published advising of the Council's consideration of a Water Capital <br />Recovery Fee Ordinance on June 25, 1984, and that capacity of the pack- <br />age plant be offered in the order listed on the City Manager's reconunen- <br />dations listed as No.3. <br /> <br />Mayor Craddock introduced a report from the City Attorney regarding <br />a proposed sale by the City of Lots A, B, C, D, E, F and G in Farm <br />Lot 12. Mr. Hankins advised the Master Plan shows portions of this <br />area to remain permanent open space (public property) and that the <br />City does not own Lot D. Mayor Craddock directed the matter be cleared <br />up as soon as possible. <br /> <br />Mayor Craddock introduced a discussion regarding railroad crossing pro- <br />tection devices and direction to be given Staff. A letter dated May <br />25, 1984 from the State Department of Highways and Public Transporta- <br />tion received from Thomas E. Word advised that only one of four of <br />the railroad crossings the City needs at this time is being considered <br />in a tentative listing for the 1985 Federal Railroad Signal Program, <br />which lS funded from fixed State and Federal appropriations. That <br />is the crossing at RM12. Approval for the 1985 program will occur in <br />October of 1984. The other three crossing not being considered in <br />the 1985 funding year are Loop 82 (control: 366-1, DOT 447 683F), <br />Loop 82 (control: 366-1, DOT 447 682Y) and C. M. Allen Parkway <br />(DOT 447 680K). Mr. Word suggested the City of San Marcos may wish <br />to negotiate directly with the railroads for installation of safety <br />devices with the City funding such improvements, as Austin does. <br /> <br />Mayor Craddock introduced a discu~ion of signalization at Uhland <br />Road intersection with MKT Railro. crossing and to consider approval <br />of the City's participation of fun ing such signalization. The Coun- <br />cil directed the letter prepared by Mr. Gonzalez be forwarded to Mr. <br />Thomas E. \10rd of the State Dept. of Highways and Public Transporta- <br />tion stating our willingness to contribute 5% of the cost of the signali- <br />zation of gates, signals and other electronic equipment (total estimated <br />cost equals $85,000). <br /> <br />Mayor Craddock moved the Council adjourn into Executive Session pursuant <br />to Article 6252-17, §2(e) and 2(g), V.A.C.S., to discuss contemplated <br />litigation and pending litigation (Kyle vs. City) and matters where the <br />
