<br /> <br /> <br /> <br />105 <br /> <br />ORDINANCE 1988-40 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING THE FOLLOWING SECTIONS OF CHAPTER <br />30, ARTICLE II, DIVISION 5, WATER SYSTEM CAPITAL RECOVERY <br />FEE: SECTION 30-61 TO REDEFINE "LUE"; SECTION 30-64 TO <br />REDEFINE" LUE"; SECTION 30-65 TO BREAK DOYAJN THE LUE <br />COMPUTATION FOR RESIDENTIAL USES INTO TWO (2) CATEGORIES, <br />TO AMEND THE LUE COMPUTATION FOR RESTAURANT/BAR, FOR <br />HOTEL/MOTELS WITH RESTAURANT AND/OR BAR, FOR LAUNDROMATS, <br />AND FOR CAR WASHES, TO DELETE THE REFERENCES UNDER <br />"HOTEL/MOTELS WITH RESTAURANT AND/OR BAR" AND <br />"RESTAURANT/BAR" WITH RESPECT TO THE ASSESSMENT OF AN <br />ADDITIONAL ANNUAL FEE, TO DELETE THE REFERENCE UNDER <br />"INDUSTRIAL" TO ANNUAL INCREASE ADJUSTMENTS IN THE CRFN, <br />TO ADD PROVISIONS FOR REASSESSMENT OF ANNUAL USAGE FEES <br />FOR ALL NON-RESIDENTIAL USES FOR A FIVE (5) YEAR PERIOD, <br />TO AMEND TERMS IN THE FORMULA USED FOR CALCULATION OF <br />THE ANNUAL USAGE FEES; SECTION 30-68 TO REDEFINE LUEEC; <br />AND DECLARING AN EFFECTIVE DATE. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> <br />SAN <br /> <br />MARCOS, <br /> <br />TEXAS: <br /> <br />SECTION 1. That Section 30-61 of Division 5 of Article II of <br />Chapter 30 of the Code of Ordinances of the City of San Marcos, Texas, <br />is hereby amended to change the definition of "Living unit <br />equivalent (LUE)" to read as follows: <br /> <br />Livinq unit equivalent (LUE). A unit of development <br />which produces the same demand as is produced by a <br />single-family dwelling unit with three (3.0) occupants and <br />an average water consumption of three hundred thirty-eight <br />(338) gallons per day per unit. <br /> <br />SECTION 2. That <br />of said Chapter of <br />follows: <br /> <br />Section 30-64 of said Division of said Article <br />said Code is hereby amended to read as <br /> <br />Sec. 30-64. <br /> <br />Amount of charge for new construction. <br /> <br />. . . <br /> <br />Living Unit Equivalent (LUE)=unit of development which <br />produces the same flow of three hundred thirty-eight (338) <br />gallons of water use per day as derived in Section 30-65. <br /> <br />of <br /> <br />SECTION 3.
