105 ORDINANCE 1988-40 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE FOLLOWING SECTIONS OF CHAPTER 30, ARTICLE II, DIVISION 5, WATER SYSTEM CAPITAL RECOVERY FEE: SECTION 30-61 TO REDEFINE "LUE"; SECTION 30-64 TO REDEFINE" LUE"; SECTION 30-65 TO BREAK DOYAJN THE LUE COMPUTATION FOR RESIDENTIAL USES INTO TWO (2) CATEGORIES, TO AMEND THE LUE COMPUTATION FOR RESTAURANT/BAR, FOR HOTEL/MOTELS WITH RESTAURANT AND/OR BAR, FOR LAUNDROMATS, AND FOR CAR WASHES, TO DELETE THE REFERENCES UNDER "HOTEL/MOTELS WITH RESTAURANT AND/OR BAR" AND "RESTAURANT/BAR" WITH RESPECT TO THE ASSESSMENT OF AN ADDITIONAL ANNUAL FEE, TO DELETE THE REFERENCE UNDER "INDUSTRIAL" TO ANNUAL INCREASE ADJUSTMENTS IN THE CRFN, TO ADD PROVISIONS FOR REASSESSMENT OF ANNUAL USAGE FEES FOR ALL NON-RESIDENTIAL USES FOR A FIVE (5) YEAR PERIOD, TO AMEND TERMS IN THE FORMULA USED FOR CALCULATION OF THE ANNUAL USAGE FEES; SECTION 30-68 TO REDEFINE LUEEC; AND DECLARING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That Section 30-61 of Division 5 of Article II of Chapter 30 of the Code of Ordinances of the City of San Marcos, Texas, is hereby amended to change the definition of "Living unit equivalent (LUE)" to read as follows: Livinq unit equivalent (LUE). A unit of development which produces the same demand as is produced by a single-family dwelling unit with three (3.0) occupants and an average water consumption of three hundred thirty-eight (338) gallons per day per unit. SECTION 2. That of said Chapter of follows: Section 30-64 of said Division of said Article said Code is hereby amended to read as Sec. 30-64. Amount of charge for new construction. . . . Living Unit Equivalent (LUE)=unit of development which produces the same flow of three hundred thirty-eight (338) gallons of water use per day as derived in Section 30-65. of SECTION 3. That Section 30-65 of said Division of said Article said Chapter of said Code is hereby amended to read as follows: Sec. 30-65. Computation of living various permitted uses. unit equivalents for . . . (b) The following schedule shall be used in determining LUE for the uses specified: the TYPE OF USE LUE PER UNIT OF DEVELOPMENT (1) Residential a. Sing le- fami 1y (includes duplexes) LUE/Dwelling Unit 1.0 b. Multi-family 0.66 LUE/Dwelling Unit . . . (3) Hotel/motels with restaurant and/or bar 0.25 LUE/Room plus 0.001 LUE/sq. ft. of bldg. in restaurant and/or bar . . . (5) Restaurant/Bar 0.001 LUE/sq. ft. of bldg.
