6.02 Karnack shall maintain an office in the City which shall be open during all usual business hours, having a listed tetephone, and be so operated that complaints and request for repairs or adjustments may be received at any time. Complaints must be received 24 hours per day. Karnack shall maintain a force of one or more residing agents or employees at all times and shall have sufficient employees to provide safe, adequate, and proper services for its facilities. 6.03 The service furnished by Karnack to the City and its inhabitants shall be first class in all respects and shall be such as will ensure the least danger to life and property. It shall at all times conform to those technical standards adopted from time to time by the F.C.C. and set forth and contained in Part 76, Section 76.605, "Technical Standards" of the F.C.C. Rules and NCTA standards of good engineering practice for measurement of cable television systems, NCTA 008- 0477. 6.04 All installations made by Karnack shall be in good, substantial, safe condition and maintained in such condition at all times. Karnack shall make no excavations in the streets, alleys and public places, without first procuring a written permit from authorized representatives of the City and all work of such kind shall be done under the supervision of the City authorities and so as to meet the approval of the City's Engineer. 6.05 All installations and connections of wires, cables and lines from Karnackls equipment and facilities to subscribers' residence and buildings shall be made and constructed so that they shall be waterproof and inaccessible to insects and vermin. 6.06 These are the minimum specifications to be maintained throughout the term of the franchise. However, should improvements in technology cause these performance standards to become outdated, the standards shall be updated, amended, or otherwise revised to reflect changed conditions, improved technology, or the state-of-the-art and this franchise shall be so amended. 6.07 Karnack will, within five years of the effective date of this agreement, provide a system capable of passing 400 MHz of the cable television spectrum. 7. Service to Schools and Hospitals 7.01 Karnack shall provide basic monthly service at no cost to public school locations within the City for educational purposes, to city or public-owned hospitals, and to City offices and agencies. Karnack's obligation to a hospital is limited to periods the hospital's patients are not charged a fee for use of television sets or signal within the hospital IS facilities. 7.02 Karnack's obligation is to provide signal to the premises of the locations mentioned above with costs of wiring such locations in excess of one outlet to be borne by the agency served on a basis not to exceed Karnack's direct costs of installation. 8. Compliance with Applicable Laws and Ordinances 8.01 Karnack shall, at all times during the life of this grant, be subject to all lawful exercise of the police power by the City and to such reasonable regulations as the City shall provide by valid resolution or ordinance. - Page 4 -
