<br />8.02 Karnack further agrees to comply in all <br />respects with the provisions of the Charter of the City of San <br />Marcos as it now exists or may be amended. <br /> <br />8.03 Karnack shall operate its cable television <br />system in accordance with the laws of the State of Texas, of the <br />Congress of the United States, and the regulations of the Federal <br />Communications Commission which may now 'or later be applicable. <br />Nothing in this document shall be construed to grant Karnack any <br />right or privilege lawfully within the jurisdiction of any other <br />regulatory body or agency, and Karnack shall secure and hold all <br />necessary licenses, permits and authorizations as may be required <br />in order to carryon a community antenna television service. <br /> <br />9. <br /> <br />Insurance <br /> <br />9.01 Karnack shall procure and furnish and file with <br />the City Secretary a policy of insurance approved by the City <br />Attorney covering liability and property damage with the minimum <br />amounts of liability as follows: One Hundred Thousand Dollars <br />($100,000.00) for anyone single personal injury to anyone <br />person. Three Hundred Thousand Dollars ($300,000.00) for <br />personal injury in anyone single accident; and One Hundred <br />Thousand Dollars ($100,000.00) property damage for anyone single <br />acc i dent. <br /> <br />10. <br /> <br />Karnack Rules <br /> <br />10.01 Karnack shall have the authority to promulgate <br />such rules, regulations, terms and conditions governing the <br />conduct of its business as shall be reasonably necessary to <br />enable Karnack to exercise its rights and perform its obligations <br />under this grant, and to assure an uninterrupted service to each <br />and all of its customers; provided, however, that such rules, <br />regulations, terms and conditions shall not be in conflict with <br />these provisions or with laws of the State of Texas. Karnack <br />will provide for appropriate refunds to be furnished subscribers <br />if service is not rendered as agreed. <br /> <br />11. <br /> <br />for any <br />designee <br />Karnack <br />the plan <br /> <br />Conditions on Street Occupancy <br /> <br />11.01 Plan submission: Karnack shall submit plans <br />change in street occupancy to the City Manager or his <br />at least thirty (30) days prior to the planned change. <br />shall not make any change without review and approval of <br />by the City Manager or his designee. <br /> <br />11.02 Use: Karnack may use the poles, lines, <br />conduits, cables or other facilities maintained by the telephone <br />company and S.M.E.U. when and where they can be obtained, <br />provided agreements satisfactory to Karnack can be entered into <br />with the utility companies, in lieu of constructing its own poles <br />in order to carry its cables and conduits and other equipment <br />that may be necessary in order to conduct its business in the <br />City. <br /> <br />11.03 Location: Subject to Section 11.01 above, <br />Karnack shall not place poles or fixtures where they will <br />interfere with any gas, electric or telephone fixtures, water <br />hydrant or main, and all such poles or other fixtures placed in <br />any street shall be placed at the outer edge of the sidewalk and <br />inside the curbline and those placed in alleys shall be placed <br />close to the side lot line of the lot abutting the alley, and <br />then in a manner not to interfere with the usu~l travel on <br />streets, alleys and public ways. Karnack may use existing poles, <br />except where service is provided by underground installation. <br /> <br />- Page 5 - <br />
