On roll call the following vote was recorded: <br /> AYE: Coddington, Farr, Craddock, Kissler. <br /> NAY: Guerra. <br /> ABSTAIN: None. <br />The Council then voted unanimously for adoption of the Ordinance. <br />Mayor Craddock introduced for consideration adoption of a Resolution, <br />the caption which was read as follows: <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, AUTHORIZING AND APPROVING THE EMPLOY- <br /> MENT OF FREESE AND NICHOLS, INC. FOR THE PROVISION <br /> OF ENGINEERING SERVICES TO SAID CITY IN CONNECTION <br /> WITH THE CONSTRUCTION OF A PACKAGE WASTEWATER TREAT- <br /> MENT PLANT FOR SAID CITY TO PROVIDE INTERIM TREAT- <br /> MENT CAPACITY UNTIL EXPANSION OF THE CONTACT STABI- <br /> LIZATION PLANT (PLANT NO. 2) IS COMPLETE; APPROVING <br /> THE TERMS AND CONDITIONS OF A LETTER AGREEMENT BETWEEN <br /> SAID FREESE AND NICHOLS, INC. AND SAID CITY AS AMENDED <br /> BY THE ATTACHED MEMORANDUM FROM A. C. GONZALEZ TO MAYOR <br /> EMMIE CRADDOCK AND MEMBERS OF THE CITY COUNCIL; AUTH- <br /> ORIZING THE CITY MANAGER OF SAID CITY TO EXECUTE SAID <br /> LETTER AGREEMENT AS AMENDED ON BEHALF OF SAID CITY <br /> AND DECLARING AN EFFECTIVE DATE. <br />Mayor Craddock moved for adoption of the Resolution and Mr. Farr se- <br />conded the motion. Mr. Farr moved to amend the Letter Agreement to <br />add the following language in the last sentence in the next to last <br />paragraph on Page 2: If a construction contract is not awarded with- <br />in ninety days from completion of final plans and specifications, the <br />fee ceiling will be based on the Engineer's final estimate of probable <br />construction cost "or billable hours worked, whichever is less". Mr. <br />Guerra seconded the motion, which passed unanimously. Mayor Craddock <br />moved to amend the Letter Agreement in the last sentence at the bottom <br />of the first page, which continues at the top of the second page in <br />(2 . . . "nor be responsible for the actual supervision of construc- <br />tion operations or for the safety measures that the contractor takes <br />or should take, "however, the engineer will exercise diligence in per- <br />forming his duties to accepted professional standard;" . . . Mr. <br />Coddington seconded the motion, which passed unanimously. The Council <br />then voted unanimously for adoption of the Resolution. <br />Mayor Craddock introduced for consideration approval for authorization <br />to bid the Wastewater Treatment Plantlmprovements (including Main Lift <br />Sta tion) after the City Attorney's review and approval of the bid docu- <br />ments. Mr. Farr moved approval for authorization to bid with the fol- <br />lowing provisos: (1) the bid documents contain a non-collusion affi- <br />davit and (2) requirement that the bid documents have all typographical <br />and grammatical errors corrected prior to bidding.
