154 RESOLUTION 1988-68R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS APPROVING A SUBSTANTIAL COMPLETION PAYMENT TO DRYMALLA CONSTRUCTION COMPANY, INC. FOR ITS WORK ON THAT PROJECT KNOWN AS THE PUBLIC WORKS COMPLEX, SAN MARCOS, TEXAS, ACCEPTING SAID PROJECT FOR SUBSTANTIAL USE BY SAID CITY, AUTHORIZING A SUBSTANTIAL COMPLETION PAYMENT IN THE AMOUNT OF $243,469.50 PROVIDED DRYMALLA CONSTRUCTION COMPANY, INC. PROVIDES SATISFACTORY EVIDENCE THAT ALL OF ITS INDEBTEDNESS CONNECTED ~vITH SAID PROJECT HAS BEEN PAID OR OTHERWISE SATISFIED, AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City of San Marcos, Texas, has engaged the services of Drymalla Construction Company, Inc. for construction of that project known as the Public Works Complex, San Marcos, Texas; and, WHEREAS, said services were provided pursuant to a contract between the Ci ty of San Marcos, Texas, and said contractor entered into on January 29,1987; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: Par t 1. Tha t the proj ec t known as the publ ic Wor ks Complex has been substant ially completed pursuant to that contract of January 29th, 1987, between said City and Dryrnalla Construction Company, Inc. Part 2. That a substantial completion payment in the amount of $243,469.50, as full payment for substantial completion for sa id serv ices is hereby author i zed, prov ided that Drymalla Construction Company, Inc. prov ides satisfactory evidence that all of its indebtedness connected with said project has been paid or otherwise satisfied.
