7
Regular Meeting June 25, 1984 Page 7
Mayor Craddock introduced for discussion the proposed sale of Urban
Renewal Property. City Attorney Hankins stated that this was a
follow up to the earlier report. He said that the City never sold
any land that we did not own. He reviewed all the recent Urban
Renewal Sales transactions. There is one piece of land that the
Council has approved and Mayor Craddock has signed the deed, but we
have not turned the deed over to Mr. Lee Swift, but he still wants
it. The land in question needs to remain some public use by requirements
by both the Urban Renewal Plan and Master Plan. Tract A, B & C
of Farm Lot 11 that was sold to Lee Swift, has the same problem
that both the Urban Renewal Plan and the Master Plan and even the Zoning
call for it to remain in public use. Block 39, Section 2, Victory Gardens,
II has an incompatible Urban Renewal Land Use and Master Plan Land Use
requirement. The Urban Renewal Land Use call for it to be Commerical, and
the Master Plan Land Use calls for it to be Low Density Residential. Mr.
Hankins stated that the Tract sold to Lucy Badillo also has an incompatiblE
Urban Renewal Land Use and Master Plan Land Use. The Urban Renewal Land
Use calls for Multi-Family and the Master Plan Land Use calls for Low
Density. The Last Tract that has problems was sold to Bill Boyd. The
Urban Renewal Land Use call for it to be Mixed Useage and the Master Plan
calls for Low Density Residential. Every other piece of land sold is
compatible. City Attorney Hankins suggested that the staff notify the
owners and tell them about the problem.
Mr. Farr moved that the Council adjourn into Executive Session pursuant
to Article 6252-17, §2(g) and §2 (e), V.A.C.S., to discuss personnel and
contemplated litigation and matters where the duty of a public body's
counsel to his client pursuant to the Code of Professional Responsibility
clearly conflicts with this Article, and Mr. Coddington seconded the
motion, which passed unanimously (10:10 p.m.).
Mr. Farr moved the Council convene at 11:27 p.m. and Mr. Guerra seconded
the motion, which passed unanimously.
The meeting adjourned at 1l:28~ a ~tion made by Mr. Guerra and
seconded by Mr. Brown.
Enunie
M~~-€-
Lll Coddington
Council Member
1
Fred Guerra
Council Member
Susan E.
