from the Edwards Aquifer in exchange for payment to the city of $145,800 in lease <br />payments; and declaring an effective date. <br />15.Consider approval of Resolution 2013 -152R, authorizing the City Manager to execute a <br />fourth amended and restated contract for collection and disposal of solid waste and <br />recyclable materials with Texas Disposal Systems, Inc. providing for a change in the size <br />of the Base -Rate Garbage Cart from 96 to 65 Gallon capacity; and declaring an effective <br />date. <br />MOTION: Upon a motion made by Council Member Porterfield and a second by Council <br />Member Prather, the City Council voted seven (7) for and none (0) opposed, to approve the <br />consent agenda, with the exception of item 14 and 15, which were pulled and considered <br />separately. The motion carried unanimously. <br />(14) MOTION: Upon a motion made by Council Member Scott and a second by Council <br />Member Thomaides, the City Council voted five (5) for and two (2) opposed, Council Member <br />Porterfield and Council Member Thomaides, to approve Resolution 2013 -151R, as previously <br />captioned. The motion carried. <br />(15) MOTION: Upon a motion made by Council Member Becak and a second by Council <br />Member Prather, the City Council voted seven (7) for and none (0) opposed, to approve <br />Resolution 2013 -152R, as previously captioned. The motion carried unanimously. <br />Public Hearings <br />16. 0OPM Receive a Staff presentation and hold a Public Hearing to receive comments for <br />or against the Water Reuse Expansion Feasibility Study, and provide direction to Staff. <br />Steven Jenkins with RPS provided a brief presentation. Mayor Guerrero opened the Public <br />Hearing 8:12 p.m. <br />There being no comments, the Mayor closed the Public Hearing at 8:12 p.m. <br />Non Consent <br />17.Consider approval of Ordinance 2013 -57, on the second of two readings, amending <br />Chapter 34, Article 5, Division 2 of the San Marcos City Code by adding provisions to <br />prohibit smoking in the enclosed areas of all public places and workplaces; providing <br />exceptions; providing penalties; providing for severability; and providing an effective <br />date. <br />MOTION: Upon a motion made by Council Member Scott and a second by Council Member <br />Porterfield, MOTION TO AMEND: Upon a motion made by Council Member Scott and a <br />second by Council Member Thomaides, the City Council voted (6) for and (1) opposed, Mayor <br />Guerrero to amend Section 34.257 (D) by adding a 10 ft. buffer.
