City and declaring an effective date. <br />MOTION: Upon a motion made by Council Member Porterfield and a second by Council <br />Member Prather, the City Council voted seven (7) for and none (0) opposed, to approve <br />Resolution 2013 -133R, as previously captioned. The motion carried unanimously. <br />23.Consider approval of Resolution 2013 -153R expressing the City's opposition to a <br />proposed truck stop at the intersection of Yarrington Road and IH -35 access road in the <br />City of Kyle; and requesting Kyle City Officials to deny any legislative <br />recommendations and approvals in support of the truck stop; and declaring an effective <br />date. <br />MOTION: Upon a motion made by Council Member Becak and a second by Council Member <br />Scott, MOTION TO AMEND: Upon a motion made by Council Member Porterfield and a <br />second by Council Member Thomason, the City Council voted seven (7) for and none (0) <br />opposed, to amend by removing the language of P &Z Commission within the second paragraph <br />of the Resolution. The motion carried unanimously. MAIN MOTION: the City Council voted <br />seven (7) for and none (0) opposed, to approve Resolution 2013 -153R, as previously captioned. <br />The motion carried unanimously. <br />24.Consider approval of Resolution 2013 -154R approving an Economic Development <br />Incentive Agreement with Mensor Corporation pursuant to Section 1.4.4.1 of the Land <br />Development Code (LDC) that grants a waiver of the requirement under Section 7.4.2.3 <br />of the LDC to install sidewalks on both sides of a lot with double street frontage as part <br />of the expansion of the manufacturing facility at 201 Barnes Drive; authorizing the City <br />Manager to execute said agreement on behalf of the City; and declaring an effective <br />date. <br />MOTION: Upon a motion made by Council Member Becak and a second by Council Member <br />Prather, the City Council voted seven (7) for and none (0) opposed, to approve Resolution 2013 - <br />154R, as previously captioned. The motion carried unanimously. <br />25.Consider an appeal filed by Brian Harper d /b /a BRSP, LLC, regarding the Planning <br />and Zoning Commission's decision approving a 6 month Conditional Use Permit to <br />allow on- premise consumption of alcoholic beverages, with conditions, at 202 East San <br />Antonio Street, San Marcos, TX 78666. <br />MOTION: Upon a motion by Mayor Guerrero and a second by Council Member Thomaides, <br />the City Council voted seven (7) for, and none (0) opposed, to overturn the Planning and Zoning <br />Commission's decision by approving a 3 year CUP allowing indoor live music and outside <br />amplified music any day of the week. The motion carried unanimously. <br />26.Consider an appeal filed by HDH, LLC regarding the Planning and Zoning <br />Commission's decision to deny the Conditional Use Permit application to allow on- <br />premise consumption of alcoholic beverages at 205 West Hopkins Street, San Marcos, <br />TX 78666. <br />
