<br /> <br /> <br /> <br />52 <br /> <br />ORDINANCE 1988-61 <br /> <br />AN ORDINANCE OF THE CITY' COUNCIL OF THE CITY' <br />OF SAN MARCOS, TEXAS AÞ-1ENDING SECTION 3 OF <br />THAT ORDINANCE \'?HICH REGULATES AND RESTRICTS <br />THE LOCATION AND USE OF BUILDINGS, STRUCTURES <br />AND LAND, DATED JUNE 13, 1984, (VOLUME 66) BY <br />CHANGING THE ZONING OF A 26.49 ACRE TRACT OF <br />LAND LOCATED ON THE WEST SIDE OF BISHOP STREET <br />AT LANCASTER STREET FROM PLANNED UNIT <br />DEVELOPMENT (SINGLE-FAMILY DWELLINGS) TO <br />PLANNED UNIT DEVELOPMENT (ZERO LOT LINE <br />S INGLE-FAMILY' DWELLINGS) FOR SAID 26.49 ACRE <br />TRACT OF LAND; AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />WHEREAS, on July 19, 1988, the Zoning Commission of the City <br />of San Marcos held a public hearing regarding a request to change <br />the zoning from Planned Unit Development (single family dwellings) <br />to Planned Unit Development (zero lot-line single-family <br />dwell ings) for a 26.49 acre tract of land, Parklane Garden Homes <br />(currently Sunridge), located on the West side of Bishop Street at <br />Lancaster Street, sa id tract being located in San Marcos, Hays <br />County, Texas; and, <br /> <br />WHEREAS, subsequent to said public hearings on said date, <br />said commissions did on July 19, 1988, consider said requests and <br />the Zoning Commission voted to approve the same subject to <br />specified conditions and has recommended that said request be <br />approved by the City Council of said City; and <br /> <br />WHEREAS, said City Council held a public hearing on the 12th <br />day of September, 1988, regarding said requests; and, <br /> <br />WHEREAS, all requirements of Appendix A, General Zoning <br />Ord inance, of the code of Ord inances of the Ci ty of San Marcos <br />pertaining to amendments have been met; and, <br /> <br />WHEREAS, Section F(2), Article V, Subdivision <br />Appendix C of the Code of Ordinances of the City of <br />empowers the Planning Commission of the Ci ty of San <br />grant permits for planned unit developments, subject to <br />approval by the City Council; and, <br /> <br />WHEREAS, on July 19, 1988, the Planning Commission of said <br />City approved the granting of a permit for a Planned Unit <br />Development in accordance with a revised Planned Unit Development <br />Final Development Plan subject to specified conditions for 26.49 <br />acres located on the west side of Bishop street at Lancaster <br />Street; and, <br /> <br />Ordinance, <br />San r-1arcos <br />Marcos to <br />rev iew and <br /> <br />WHEREAS, said City Council hereby finds and determines that <br />the adoption of the following ordinance is in the interest of the <br />public health, morals, welfare and safety; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY' OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION L That the 26.49 acre tract of land (known as <br />Sunr idge Planned Uni t Development), more particularly descr ibed <br />and recorded in the Planned uni t Develpment plat records, Hays <br />County, Texas, Book 4, page 309-311, which is presently zoned <br />Planned Unit Development (single-family dwellings) henceforth <br />shall be rezoned Planned ani t Development (zero lot-l ine <br />single-family dwellings) and renamed parklane Garden Homes Planned <br />Unit Development. <br /> <br />SECTION 2. That the Zoning Commission's approval of the <br />Parklane Garden Homes Planned Unit Development Plan (zero-Iot-1ine <br />single-family dwellings) described in Exhibit "A" which is <br />attached hereto and incorporated herein for all purposes is hereby <br />approved for the sa id 26.49 acres, the boundar ies of which are <br />more particularly descr ibed in the Planned Uni t Development plat <br />records of Hays County, Texas, Book 4, pages 3Ø9-3l1, under the <br />name Sunridge Planned Unit Development. <br />
