<br /> <br />rn <br /> <br /> <br /> <br />t' <br />~ <br /> <br />57 <br /> <br />ORDINANCE 1988-64 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING CHAPTER 33, WRECKERS, OF <br />THE CODE OF ORDINANCES OF SAID CITY DELETING ALL <br />REFERENCE TO SAN MARCOS DEPARTMENT OF PUBLIC SAFETY <br />AND IN ITS PLACE SUBSTITUTING SAN MARCOS POLICE <br />DEPARTMENT; ADDING SECTION 33-2 REQUIRING <br />CERTIFICATION OF REGISTRATION; RENUMBERING THE <br />REMAINING SECTIONS OF SAID CHAPTER; AMENDING NEW <br />SECTION 33-4 TO ESTABLISH TWO ROTATION FILES BASED <br />ON WRECKER CAPACITY; MODIFYING PROVISIONS IN NEW <br />SECTION 33-6 PERTAINING TO THE ROTATION LOG ON <br />WRECKER AVAILABILITY; AMENDING NEW SECTION 33-7 <br />PERTAINING TO THE EQUIPPING OF WRECKERS; AMENDING <br />NEW SECTION 33-9 TO RAISE TOW FEES AND STORAGE <br />FEES I AND ESTABLISH A FEE FOR WAITING TIME AND <br />EXCEPTIONAL LABOR; ADDING NEW SECTION 33-10 <br />ESTABLISHING AN ADMINISTRATIVE FEE; RENUMBERING <br />SECTION 33-10 TO 33-11 AND RENUMBERING SUBSEQUENT <br />SECTIONS; AMENDING NEW SECTION 33-11(a) TO INCREASE <br />THE REQUIRED MINIMUM INSURANCE FOR COMBINED SINGLE <br />LIMIT COVERAGE, FOR CARGO INSURANCE AND THE AMOUNT <br />OF SURETY BOND; CLARIFYING LANGUAGE IN NEW SECTION <br />33-11(c) REGARDING ANY COMPLAINT ABOUT A COMMERCIAL <br />TOWING AND WRECKER SERVICE; AMENDING NEW SECTION <br />33-12 TO ESTABLISH BUSINESS HOURS FOR RELEASE OF <br />IMPOUNDED VEHICLES AND A FEE FOR AFTER-HOUR <br />RELEASE; AND ADDING PROVISIONS FOR POLICE <br />DEPARTMENT INSPECTION OF IMPOUNDED VEHICLES; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That Chapter 33, Wreckers, of the <br />Ordinances of said City is hereby amended as follows: <br /> <br />Code <br /> <br />of <br /> <br />Sec. 33-1. Purpose. <br /> <br />The purpose of this chapter is to provide the City of San <br />Marcos with a means of performing the police power function <br />of maintaining the streets and public ways open to public <br />traffic through the voluntary participation of privately <br />owned commercial towing and wrecker services. <br /> <br />Sec. 33-2. Scope. <br /> <br />This chapter shall apply to all commercial towing and wrecker <br />services participating in the rotation system of notification <br />operated by the San Marcos Police Department. <br /> <br />Sec. 33-3. Certificate of Registration. <br /> <br />All commercial towing and wrecker services participating in <br />the rotation system of notification operated by the San <br />Marcos Police Department shall have a current certificate of <br />registration on any wrecker responding to a rotation system <br />call. The certificate of registration shall be available fo~ <br />inspection at the request of a San Marcos police officer" <br />Failure to have a current certificate of registration on ary <br />wrt=cker U:::it:=ù OJ a wJ.,'ecker service shall result in suspension <br />of that towing and wrecker service from the rotation system <br />of notification for a period not to exceed thirty (30) days <br />per violation. <br /> <br />Sec. 33-4. Notification. <br /> <br />Each commercial towing and wrecker service shall provide <br />their business name, address, telephone number, normal <br />business hours and an operator's name, address and telephone <br />number for after-hour calls. Two separate rotation files and <br />activity logs shall be maintained by communication personnel <br />of the San Marcos Police Department. One file shall consist <br />of category "A" commercial towing and wrecker services with <br />
